Stat. tit. 52, § 52-318.3","heading":"Notice of intent to drill - Negotiating surface damages","body":"Before entering upon a site for oil or gas drilling, except in\n\ninstances where there are non-state resident surface owners, non-\n\nstate resident surface tenants, unknown heirs, imperfect titles,\n\nsurface owners, or surface tenants whose whereabouts cannot be\n\nascertained with reasonable diligence, the operator shall give to\n\nthe surface owner a written notice of his intent to drill containing\n\na designation of the proposed location and the approximate date that\n\nthe operator proposes to commence drilling.\n\nSuch notice shall be given to the surface owner in any manner as\n\nprovided for in paragraph 1 and paragraph 2 of subsection C of\n\nSection 2004 of Title 12 of the Oklahoma Statutes for the service by\n\npersonal delivery or by mail of a summons in a civil action. If the\n\noperator makes an affidavit that he has conducted a search with\n\nreasonable diligence and the whereabouts of the surface owner cannot\n\nbe ascertained or such notice cannot be delivered, then constructive\n\nnotice of the intent to drill may be given in the same manner as\n\nprovided for the notice of proceedings to appoint appraisers.\n\nWithin five (5) days of the date of delivery or service of the\n\nnotice of intent to drill, it shall be the duty of the operator and\n\nthe surface owner to enter into good faith negotiations to determine\n\nthe surface damages.","path":["OK Code","Title 52"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os52.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"3522dbae0f00aa7c2accaa5f20901b14aa8559e63a85fc9dd48b38918005416e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-52-52-318.23","next":"us-ok/okla.-stat.-tit.-52-52-318.4"},"notice":"GroundRules: Original legal text.
