Stat. tit. 52, § 52-36.5","heading":"Petition to district court - Examination and","body":"determination - Subsequent proceedings.\n\nAny public utility having first obtained a certificate from the\n\nCommission as hereinbefore provided, desiring to exercise the right\n\nof eminent domain for the purpose of acquiring property for the\n\nunderground storage of natural gas shall do so in the manner\n\nhereinafter provided. Such public utility shall present to the\n\ndistrict court of the county wherein the land is situated, or to the\n\njudge thereof, a petition setting forth the purpose for which the\n\nsaid property is sought to be acquired, a description of the\n\nproperty sought to be appropriated and the names of the owners\n\nthereof as shown by the records of such county. The petitioner\n\nshall file the certificate of the Commission as a part of its\n\npetition and no order by the court granting said petition shall be\n\nentered without such certificate being filed therewith. The court\n\nor the judge thereof shall examine said petition and determine\n\nwhether the petitioner has the power of eminent domain and whether\n\nsaid property is necessary to its lawful purposes, and if found in\n\nthe affirmative, such finding shall be entered in the record and\n\nsubsequent proceedings shall follow the procedure now provided by\n\nlaw in the exercise of the rights of eminent domain by railroads.","path":["OK Code","Title 52"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os52.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"3ed74f919ea3e0ed89fad6ad2fe33a57ac822ed8be55981456a0c054aab0d72f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-52-52-36.4","next":"us-ok/okla.-stat.-tit.-52-52-36.6"},"notice":"GroundRules: Original legal text.
