There is hereby re-created the Oklahoma Liquefied Petroleum\n\nGas Board, hereinafter sometimes referred to as \"LP-Gas Board\" or\n\n\"Board\". The Board shall be composed of seven (7) members, one each\n\nfrom the southeastern, northeastern, northwestern and southwestern\n\nquarters of the state, one from central Oklahoma, and two from the\n\nstate at large. Each appointment shall be made by the Governor,\n\nfrom a list of three or more nominees who have certified in writing\n\ntheir willingness to serve, to be submitted to him by the persons,\n\nfirms or corporations required to be registered pursuant to the\n\nprovisions of Sections 420.1 through 420.15 of this title, or by\n\ntheir representatives, and shall be subject to confirmation by the\n\nSenate.\n\nB. No person shall be appointed as a member of the Board unless\n\nat the time of his or her appointment he or she has been a legal\n\nresident of the State of Oklahoma for at least five (5) years\n\npreceding the date of his or her appointment and, except for the two\n\nmembers at large, shall have actively engaged in the retail\n\ndistribution of liquefied petroleum gas in Oklahoma for a period of\n\none (1) year, or more. One of the members at large shall be engaged\n\nin and representative of the container and appliance phases of the\n\nLPG business in Oklahoma, and the other shall have a general\n\nfamiliarity with the regulatory problems of the industry and the\n\nconsuming public. Provided, however, that the appointment of such\n\npublic member shall not be subject to the aforementioned list which\n\nis required to be submitted to the Governor. Members shall be\n\neligible for reappointment for successive terms, and shall be\n\nremovable for cause by the Governor. A member shall automatically\n\nbe disqualified to hold such office in event he or she ceases to be\n\na legal resident of the State of Oklahoma or ceases to be actively\n\nengaged in the LPG business in Oklahoma.\n\nC. Re-creation shall not alter existing membership or terms of\n\noffice. Members shall serve until their successors in office are\n\nduly appointed and qualified. Initial appointments of those members\n\nof the Board from the designated geographical areas of the state\n\nshall be for terms ranging from one (1) to five (5) years, the\n\nGovernor to designate same, and the initial terms of office of the\n\nmembers at large on the Board shall be for one (1) and two (2)\n\nyears, respectively, as designated by the Governor. Thereafter, the\n\nterms of all members shall be for four (4) years. In the event of\n\nthe death, resignation, disqualification or incapacity of one or\n\nmore members of the Board, a recess appointment for the unexpired\n\nterm of each such member may be made by the Governor as hereinabove\n\nprovided. Members of the Board shall be entitled to be reimbursed\n\nfor necessary travel expenses as provided in the State Travel\n\nReimbursement Act.\n\nD. The Board shall organize by electing one of its members as\n\nchairman and one member as vice-chairman. The Board shall hold\n\nregular meetings. The date, time and place of any regular meeting\n\nshall be as designated by vote of the majority of the membership.\n\nFour members of the Board shall constitute a quorum for all\n\npurposes. The chairman or vice-chairman may, upon approval of a\n\nmajority of the members present and voting at any meeting, designate\n\nthe time, place and date of any scheduled special meeting, and the\n\nchairman or vice-chairman shall have the power to call an\n\nunscheduled special meeting of the Board upon not less than five (5)\n\ndays' notice in writing to each member thereof.\n\nE. The standards for the storage and handling of liquefied\n\npetroleum gases adopted by the National Fire Protection Association\n\nand published in Pamphlet No. 58 including current and subsequent\n\neditions and any subsequent changes and/or additions to the\n\npamphlet, and the standards for the installation of gas appliances\npon not less than five (5)\n\ndays' notice in writing to each member thereof.\n\nE. The standards for the storage and handling of liquefied\n\npetroleum gases adopted by the National Fire Protection Association\n\nand published in Pamphlet No. 58 including current and subsequent\n\neditions and any subsequent changes and/or additions to the\n\npamphlet, and the standards for the installation of gas appliances\n\nand gas piping adopted by the National Fire Protection Association\n\nand published in Pamphlet No. 54 including the current and any\n\nsubsequent editions and any subsequent changes and/or additions to\n\nthe pamphlet shall be the accepted standards for this state. The\n\nBoard is hereby empowered and authorized, and it shall be its duty\n\nto prescribe, adopt and promulgate, in the manner set forth in\n\nSection 420.1 et seq. of this title, rules relating to safety in the\n\nstorage, distribution, dispensing, transporting and utilization of\n\nLPG in this state and in the manufacture, fabrication, assembly,\n\nsale, installation or use in this state of LPG systems, containers,\n\napparatus or appliances, and reasonable rules governing the issuance\n\nof such permits and operations thereunder, and not inconsistent with\n\nthe Oklahoma Liquefied Petroleum Gas Regulation Act, as it shall\n\ndeem just and reasonable, and to revoke, amend or supersede such\n\nsupplementary rules.\n\nF. The Administrator shall administer and enforce all rules\n\nformulated and adopted by the Board and administer and enforce the\n\nsafety rules prescribed, adopted or promulgated by the Board under\n\nand by virtue of the provisions of the Oklahoma Liquefied Petroleum\n\nGas Regulation Act, and incur all necessary expenditures in\n\neffectuating the purposes of this subsection. The Administrator\n\nshall serve as secretary to the Board, and shall be subject to\n\nconfirmation by the Senate.\n\nG. Before any rules are revised, amended, adopted or\n\npromulgated hereunder, the Administrator, acting on behalf of the\n\nBoard, shall give ten (10) days' notice to all Class I and Class II\n\npermit holders under the Oklahoma Liquefied Petroleum Gas Regulation\n\nAct, by mailing to the permit holders a written notice, signed by\n\nthe Administrator, on behalf of the Board, containing either a\n\nstatement of the terms or substance of the intended action, a\n\ndescription of the subjects and issues involved, or an accurate copy\n\nof the new, revised or amended rules which the Board proposes to\n\nadopt and promulgate, stating the date, time and place of a public\n\nhearing at which oral or written objections to such proposals shall\n\nbe heard and considered. Notice shall also be given as required by\n\nthe Administrative Procedures Act. Nothing in this subsection shall\n\nprevent the furnishing of such other or additional notice as the\n\nBoard shall direct.\n\nH. At any hearing held under this section, not less than a\n\nquorum of the Board shall be present and shall preside; provided,\n\nhowever, that by unanimous vote and resolution, the Board may\n\nauthorize the Administrator to preside at any or all such hearings,\n\nand in such event no Board member need be present.
