Stat. tit. 52, § 52-47.3","heading":"Powers and duties of Commission","body":"The Corporation Commission shall have the power and duty to:\n\n1. Establish, administer, and enforce safety standards for the\n\ndesign, construction, maintenance, and operation of all\n\ntransportation systems for hazardous liquid;\n\n2. Advise, consult, and cooperate with other agencies of this\n\nstate, the federal government, other states, interstate agencies,\n\npolitical subdivisions, and industries, as may be necessary for the\n\ndischarge of the duties of the Commission pursuant to the provisions\n\nof the Hazardous Liquid Transportation System Safety Act;\n\n3. Accept and administer loans and grants from the federal\n\ngovernment and from other sources, public or private, for\n\nimplementing the provisions of the Hazardous Liquid Transportation\n\nSystem Safety Act;\n\n4. Adopt, modify, repeal, promulgate, and enforce rules\n\nimplementing or effectuating the powers and duties of the Commission\n\npursuant to the provisions of the Hazardous Liquid Transportation\n\nSystem Safety Act, provided such rules and regulations shall not\n\nexceed those found in 49 CFR, Part 195, as provided for by P.L. 96-\n\n129; provided that, the Commission shall not promulgate, enforce or\n\ninterpret any rule or regulation unless such rule, regulation or\n\ninterpretation shall be consistent with and no more restrictive than\n\nthe applicable rules, regulations and interpretations of the United\n\nStates Secretary of Transportation; provided further that, the\n\nCommission shall not apply or enforce any interpretation of its\n\nrules against any operator for any practice, policy or conduct that\n\ncomplies with a written procedure to minimize the hazard resulting\n\nfrom a hazardous liquid or carbon dioxide pipeline emergency when\n\nthat procedure has been annually updated and approved by the United\n\nStates Secretary of Transportation;\n\n5. Make periodic investigations and inspections of hazardous\n\nliquid transportation systems to ensure compliance with the\n\nprovisions of the Hazardous Liquid Transportation System Safety Act\n\nand rules promulgated by the Commission pursuant to the provisions\n\nof the Hazardous Liquid Transportation System Safety Act;\n\n6. Require the submission of plans, specifications, and other\n\ndata relative to hazardous liquid transportation systems, and review\n\nsaid plans, specifications, and other data. All data filed as\n\nconfidential shall be maintained as confidential and shall not be\n\nsubject to the provisions of the Oklahoma Open Records Act. Only\n\nauthorized Commission employees may access such confidential data;\n\n7. Approve or disapprove written safety plans for the\n\ninspection and maintenance of said transportation systems;\n\n8. Require reports from all persons operating or owning a\n\nhazardous liquid transportation system;\n\n9. Require the maintenance of records relating to the operation\n\nof hazardous liquid transportation systems;\n\n10. Institute or cause to be instituted any necessary legal\n\nproceedings in any court of competent jurisdiction for an injunction\n\nor other appropriate relief to enforce the provisions of the\n\nHazardous Liquid Transportation System Safety Act; and\n\n11.
