Stat. tit. 52, § 52-47.5","heading":"Determination of hazardous transportation system -","body":"Corrective action - Emergencies.\n\nA. The Commission may find a transportation system to be\n\nhazardous if:\n\n1. the facts and circumstances indicate the particular system\n\nis hazardous to life or property; or\n\n2. the transportation system or a component thereof has been\n\nconstructed or operated with any equipment, material, or technique\n\nwhich the Commission determines is hazardous to life or property.\n\nB. In determining a transportation system to be hazardous, the\n\nCommission shall consider the following, if relevant:\n\n1. the characteristics of the pipe and other equipment used in\n\nthe transportation system, including the age, manufacturer, physical\n\nproperties, and its resistance to corrosion and deterioration of\n\nsaid equipment, and the method of manufacture, construction, or\n\nassembly; and\n\n2. the nature of the materials transported by said system,\n\nincluding their corrosive and deteriorative qualities, the sequence\n\nin which the materials are transported, and the pressure required\n\nfor said transportation; and\n\n3. the aspects of the areas in which the transportation system\n\nis located, including the climatic and geologic conditions, the soil\n\ncharacteristics, and the population, population density, and growth\n\npatterns of said areas; and\n\n4. such other factors as the Commission may consider\n\nappropriate.\n\nC. If the Commission finds, after reasonable notice and an\n\nopportunity for a hearing, that any transportation system is\n\nhazardous to life or property, the Commission, by order, shall\n\nrequire the person operating the facility to take necessary\n\ncorrective action. Said corrective action may include suspended or\n\nrestricted use of the facility, physical inspection, testing,\n\nrepair, replacement, or other appropriate action.\n\nD. Whenever the Commission finds that an emergency exists\n\nrequiring immediate action in order to protect the public health and\n\nwelfare, the Commission may issue an order, without notice or\n\nhearing, stating the existence of said emergency and requiring that\n\naction be taken as the Commission deems necessary to meet the\n\nemergency. The order shall be effective immediately upon issuance.\n\nAny person to whom the order is directed shall comply immediately\n\nwith the provisions of the order, but, upon application to the\n\nCommission, shall be afforded a hearing within ten (10) days of the\n\nissuance of the order.
