Any person who has been determined by the Commission to have\n\nviolated any provisions of the Hazardous Liquid Transportation\n\nSystem Safety Act or any rule, regulation or order issued pursuant\n\nto the provisions of the Hazardous Liquid Transportation System\n\nSafety Act shall be liable for an administrative penalty of not more\n\nthan Two Hundred Thousand Dollars ($200,000.00) for each day that\n\nthe violation continues. The maximum administrative penalty shall\n\nnot exceed Two Million Dollars ($2,000,000.00) for any related\n\nseries of violations.\n\nB. 1. The amount of the penalty shall be assessed by the\n\nCommission pursuant to the provisions of subsection A of this\n\nsection, after notice and hearing. In determining the amount of the\n\npenalty, the Commission shall include but not be limited to\n\nconsideration of the nature, circumstances, and gravity of the\n\nviolation and, with respect to the person found to have committed\n\nthe violation, the degree of culpability, the effect on ability of\n\nthe person to continue to do business, and any show of good faith in\n\nattempting to achieve compliance with the provisions of the\n\nHazardous Liquid Transportation System Safety Act.\n\n2. All penalties collected pursuant to the provisions of this\n\nsubsection shall be deposited in the Pipeline Enforcement Fund.\n\nC. Any person who willfully and knowingly injures or destroys,\n\nor attempts to injure or destroy, any hazardous liquid\n\ntransportation system, upon conviction thereof, shall be guilty of a\n\nClass B3 felony offense and shall be subject for each offense to a\n\nfine of not more than Twenty-five Thousand Dollars ($25,000.00),\n\nimprisonment for a term not less than five (5) years and not to\n\nexceed fifteen (15) years, or by both such fine and imprisonment.","path":["OK Code","Title 52"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os52.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"801334f7e80bec993af77322161a3295955df94fee3b162b212cab9b18e2e834","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-52-52-47.5","next":"us-ok/okla.-stat.-tit.-52-52-47.7"},"notice":"GroundRules: Original legal text.
