Stat. tit. 52, § 52-5","heading":"Construction and operation of pipelines - Safety regulations","body":"- Markers - Promulgation of rules - Personnel - Expenses.\n\nA. The Corporation Commission is hereby authorized, directed\n\nand empowered to promulgate, adopt and enforce reasonable rules\n\nestablishing minimum state safety standards for the design,\n\nconstruction, maintenance and operation of all pipelines used for\n\nthe transmission and distribution of natural gas in this state.\n\nHowever, except as otherwise provided in subsection B of this\n\nsection, the Commission shall not promulgate, enforce or interpret\n\nany rule or regulation unless such rule, regulation or\n\ninterpretation shall be consistent with and no more restrictive than\n\nthe rules, regulations and interpretations of the United States\n\nSecretary of Transportation for pipeline transportation and pipeline\n\nfacilities. When any such transmission pipeline shall be\n\nconstructed, operated or maintained under, through and across a\n\nhighway, section-line road or improved public road or street, there\n\nshall be erected directly above where such pipeline enters or leaves\n\nsaid highway, section-line road or improved public road or street, a\n\nsuitable sign or marker stating thereon the name of the owner of\n\nsuch pipeline and such other information as the Corporation\n\nCommission may by rule direct.\n\nB. The Commission is authorized and directed to promulgate and\n\nenforce reasonable rules relating to an incident on a gathering\n\npipeline unit not subject to the U.S. Department of Transportation\n\nPipeline Safety Regulations, codified at 49 CFR Parts 191 and 192,\n\nprovided that such rules of the Commission are limited to the\n\nfollowing specified areas: telephonic notification of and a written\n\nreport about the incident which shall be consistent with and require\n\nno more information than the rules, regulations and interpretations\n\nissued by the U.S. Department of Transportation Pipeline Safety\n\nRegulations relating to the reporting of incidents, maps depicting\n\nthe location of the incident, and reasonable corrective measures to\n\nthe gathering pipeline unit involved in the incident.\n\nC. For the purposes of this section:\n\n1. “Incident” shall have the same meaning as it is defined in\n\nthe U.S. Department of Transportation, Pipeline Safety Regulations;\n\nand\n\n2. “Gathering pipeline unit” means the portion of the\n\nnonregulated gathering pipeline involved in the incident not to\n\nexceed one mile of pipeline.\n\nD. If contacted by any other entity or person regarding an\n\nincident, as defined in paragraph 1 of subsection C of this section,\n\nthe Commission may disclose to such entity or person the time, date\n\nand location of the incident, the identity of the operator involved\n\nin the incident, the size of the gathering pipeline involved and the\n\nnumber of fatalities or injuries, if any, resulting from the\n\nincident.\n\nE. With the exception of the information outlined in subsection\n\nD of this section, all reports, data, maps or other information\n\nwhich the Commission may be authorized to obtain under the\n\nprovisions of this section may be filed as confidential and the\n\nCommission shall maintain them as confidential and such records\n\nshall not be subject to the provisions of the Oklahoma Open Records\n\nAct. Only authorized Commission employees may obtain or access such\n\nconfidential records.\n\nF. The Corporation Commission may appoint a registered\n\nprofessional engineer with actual experience in the design,\n\nconstruction, maintenance or operation of natural gas pipelines, and\n\nsuch other personnel as may be provided by law, to carry out the\n\nprovisions of Section 1 et seq. of this title. Such engineer shall\n\nbe furnished with personnel, supplies and equipment as may be\n\nnecessary to carry out the provisions of Section 1 et seq. of this\n\ntitle.
