Stat. tit. 52, § 52-549.10","heading":"Expiration of oil and gas lien - Enforcement of lien","body":"EXPIRATION OF LIEN - ENFORCEMENT - JOINDER AND CONSOLIDATION -\n\nCOSTS - PERSONAL ACTIONS - OTHER RIGHTS AND REMEDIES\n\nA. An oil and gas lien shall expire, as to an interest owner,\n\none (1) year after the last day of the month following the date\n\nproceeds from the sale of oil or gas subject to such lien are\n\nrequired by law or contract to be paid to such interest owner but\n\nonly as to the oil or gas sold during such month, unless an action\n\nto enforce the oil and gas lien is commenced within such time in a\n\ncourt of competent jurisdiction. In addition to any other court of\n\ncompetent jurisdiction, an action to enforce the oil and gas lien\n\nmay be commenced in the district court of the county in which there\n\nis located the oil and gas well from which the oil or gas is\n\nproduced, or wherever the oil or gas unpaid for or the proceeds may\n\nbe found. Notwithstanding the foregoing, the commencement of any\n\nproceeding by or against any person claiming an interest in any\n\nproperty subject to the oil and gas lien seeking to adjudicate such\n\nperson as bankrupt or insolvent, or seeking liquidation, winding up,\n\nreorganization, arrangement, adjustment, protection, relief, or\n\ncomposition of such person or such person’s debts under any law\n\nrelating to bankruptcy, insolvency or reorganization or relief of\n\ndebtors, or seeking the entry of an order for relief or the\n\nappointment of a receiver, trustee or other similar official for\n\nsuch person or for any substantial part of such person’s property\n\nshall toll the foregoing one (1) year period in which to commence an\n\naction to enforce the oil and gas lien for an additional period of\n\nninety (90) days from the earlier of:\n\n1. The final conclusion or dismissal of such proceedings; or\n\n2. The date final relief is obtained from the applicable\n\ntribunal authorizing the commencement of such action.\n\nProceedings to enforce oil and gas liens involving more than one oil\n\nand gas well in one county can be joined by an interest owner in the\n\nsame action. Any number of persons claiming oil and gas liens with\n\nrespect to the oil or gas from the same oil and gas well or wells\n\nmay join in the same action and where separate actions are\n\ncommenced, the district court may consolidate them. The district\n\ncourt shall allow as part of the costs of the action all costs of\n\ncollection including, without limitation, reasonable attorney fees\n\nfor the prevailing party in the trial and appellate tribunals.\n\nB.
