Stat. tit. 52, § 52-549.3","heading":"Oil and gas lien","body":"NATURE, EXTENT AND DURATION OF OIL AND GAS LIEN\n\nA. To secure the obligations of a first purchaser to pay the\n\nsales price, and to secure the obligation of any person to pay any\n\nproceeds, as defined in Section 549.2 of this title, for the\n\nacquisition of oil and gas rights, each interest owner is hereby\n\ngranted an oil and gas lien to the extent of the interest owner’s\n\ninterest in oil and gas rights. The oil and gas lien granted by the\n\nOil and Gas Owners’ Lien Act of 2010 is granted and shall exist as\n\npart of and incident to the ownership of oil and gas rights.\n\nB. An oil and gas lien:\n\n1. Exists in and attaches immediately to all oil and gas on\n\nApril 19, 2010;\n\n2. Continues uninterrupted and without lapse in all oil and gas\n\nupon and after severance; and\n\n3. Continues uninterrupted and without lapse in and to all\n\nproceeds.\n\nC. An oil and gas lien exists until the interest owner or\n\nrepresentative first entitled to receive the sales price or any\n\nproceeds, as defined in Section 549.2 of this title, for the\n\nacquisition of oil and gas rights, has received the sales price or\n\nany proceeds, as defined in Section 549.2 of this title, for the\n\nacquisition of oil and gas rights. Notwithstanding the immediately\n\npreceding sentence, as between an interest owner and a\n\nrepresentative of an interest owner or any person claiming adversely\n\nto such interest owner or representative, such interest owner’s oil\n\nand gas lien continues uninterrupted and without lapse in proceeds\n\nin the possession or control of a representative until the interest\n\nowner on whose behalf such representative acts receives such\n\nproceeds in full. When a first purchaser, in good faith, pays the\n\nsales price to an interest owner or a representative otherwise\n\napparently entitled to receive the sales price and the first\n\npurchaser is without actual knowledge that such interest owner or\n\nrepresentative is not entitled to receive the sales price so paid,\n\nthen such first purchaser takes free of the oil and gas lien\n\notherwise applicable to the oil or gas for which such payment was\n\nmade. Notwithstanding the immediately preceding sentence, the oil\n\nand gas lien will continue uninterrupted in the proceeds paid to or\n\notherwise due the interest owner or representative.\n\nD. The validity of an oil and gas lien shall not be dependent\n\non possession of the oil or gas by an interest owner or\n\nrepresentative. No oil and gas lien shall become or be deemed to be\n\nvoid or expired by reason of a change or transfer of the actual or\n\nconstructive possession of or title to the oil or gas from the\n\ninterest owner or representative to a first purchaser or purchaser.\n\nE. On the conveyance or transfer of any oil and gas rights by a\n\ntransferor interest owner, the oil and gas lien vested in the\n\ntransferor interest owner immediately before the conveyance or\n\ntransfer shall remain with the transferor interest owner to the\n\nextent of any oil and gas rights retained by the transferor interest\n\nowner.\n\nF. On the conveyance or transfer of any oil and gas rights by a\n\ntransferor interest owner, the oil and gas lien vested in the\n\ntransferor interest owner immediately before the conveyance or\n\ntransfer shall be transferred to and attach automatically to the oil\n\nand gas rights acquired by the transferee interest owner\n\nuninterrupted and without lapse and as part of and incident to the\n\noil and gas rights so transferred or conveyed.","path":["OK Code","Title 52"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os52.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"cda28c8f1fca4ebd0cb4dab9bb2c71cd6dae27e464e8d20cf5718e9305b08bbb","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-52-52-549.2","next":"us-ok/okla.-stat.-tit.-52-52-549.4"},"notice":"GroundRules: Original legal text.
