Stat. tit. 52, § 52-549.9","heading":"Waiver, relinquishment, release","body":"WAIVER\n\nNo interest owner shall be required, as a condition or term of\n\nan agreement to sell or otherwise, to waive, relinquish or release\n\nany oil and gas lien or any rights under this act other than upon\n\npayment in full of the sales price or agree to any provision that\n\nwould apply the law of any state other than the State of Oklahoma\n\ninsofar as the same relates to rights under this act, and any such\n\npurported waiver, relinquishment, release, or provision shall be\n\nvoid as a matter of the public policy of this state.\n\nNotwithstanding the preceding sentence, any interest owner or a\n\nrepresentative acting on behalf of an interest owner, may waive,\n\nrelinquish or release any oil and gas lien or any rights under this\n\nact or agree to a provision that would apply the law of any state\n\nother than the State of Oklahoma insofar as the same relates to\n\nrights under this act only as to such interest owner’s oil and gas\n\nrights provided the first purchaser either:\n\n1. Posts a letter of credit in form and amount satisfactory to\n\nthe interest owner, or a representative acting on behalf of an\n\ninterest owner; or\n\n2. Agrees to a binding contractual arrangement satisfactory in\n\nform and substance to the interest owner, or a representative acting\n\non behalf of an interest owner to prepay or escrow the sales price\n\nunder an agreement to sell in form and substance satisfactory to the\n\ninterest owner and performs all of the first purchaser’s obligations\n\nthereunder.","path":["OK Code","Title 52"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os52.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2977d8b3c57e1835868127b235d7a904cbd3cc08eac1751047ca188b640cee41","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-52-52-549.8","next":"us-ok/okla.-stat.-tit.-52-52-55"},"notice":"GroundRules: Original legal text.
