The district courts within this state shall have the sole\n\nand exclusive jurisdiction to determine the entitlement of any owner\n\nin a well to:\n\n1. Its share of proceeds from production; or\n\n2. Damages, interest, court costs, attorney fees or allowable\n\nlitigation expenses incurred as a result of the violation of the\n\nProduction Revenue Standards Act.\n\nB. Any rulemaking power granted to the Corporation Commission\n\nby the Production Revenue Standards Act shall neither preclude nor\n\nimpair the right of any owner to obtain through the district courts\n\nremedies available under existing law or additional remedies herein\n\ngranted to any owner injured in business or property by reason of\n\nany action in violation of the provisions of the Production Revenue\n\nStandards Act.\n\nC. Any owner injured in business or property by reason of any\n\naction in violation of the provisions of the Production Revenue\n\nStandards Act shall have the right to:\n\n1. Recover actual damages so sustained; and\n\n2. Obtain specific performance where equitable.\n\nThe prevailing party in any court proceeding brought pursuant to the\n\nProduction Revenue Standards Act shall be entitled to recover the\n\ncosts of the suit, including but not limited to reasonable attorney\n\nand expert witness fees.\n\nD. 1. For purposes of the Production Revenue Standards Act,\n\nthe statute of limitations on actions brought pursuant to the\n\nprovisions of the Production Revenue Standards Act shall be five (5)\n\nyears from the date the cause of action shall have accrued;\n\nprovided, however, nothing shall create, limit or expand any statute\n\nof limitations applicable to production occurring prior to September\n\n1, 1992.\n\n2.
