For purposes of the Production Revenue Standards Act a well\n\nis out of balance when cumulative gas sales on a volumetric basis\n\nfor the account of all owners in a well have not been made in\n\nproportion to the respective net revenue interest of each owner.\n\nB. In a well wherein the cumulative gas production accounts of\n\nroyalty interest owners are out of balance, producing owners in that\n\nwell may agree to have the distribution of gas royalty proceeds\n\namong the royalty interest owners made in a manner other than\n\naccording to their proportionate royalty shares, provided that:\n\n1. Such variance shall only be permitted to the extent required\n\nto balance the cumulative gas production accounts of the royalty\n\ninterest owners; and\n\n2. Prior notice thereof is given to the royalty interest owners\n\naffected thereby, and to the operator along with any ongoing\n\ninformation necessary for the operator to discharge its duties.\n\nC.
