The following sales are exempt from the provisions of the\n\nNatural Gas Market Sharing Act:\n\n1. Sales pursuant to contracts for an initial term of more than\n\none (1) year entered into prior to January 1, 1985, or any\n\nsuccessor, replacement, or rollover contract thereto entered into\n\nprior to January 1, 1990. This subsection shall not apply to\n\nparticipating mineral owners who were sharing in any contract on\n\nJanuary 1, 1992 and continue to share in such contract on September\n\n1, 1992. Such participating mineral owners shall be subject to all\n\nother provisions of this act;\n\n2. Sales pursuant to contracts which provide for:\n\na. an initial term of more than three (3) years,\n\nb. a guarantee or warranty for delivery of fixed volumes\n\nof gas without limitation to specified wells or\n\nreserves, and\n\nc. delivery of such volumes;\n\n3. Sales of natural gas liquids extracted as a result of\n\nmechanical processing of the natural gas stream for the removal of\n\nliquid components other than methane.\n\nB. Owners in a well shall not be entitled to elect to market\n\nshare pursuant to the provisions of the Natural Gas Market Sharing\n\nAct if in such well, such owners:\n\n1. Are subject to a balancing agreement or other written\n\nagreement which expressly provides for the taking, sharing,\n\nmarketing or balancing of gas in a manner other than as provided for\n\nin the Natural Gas Market Sharing Act;\n\n2. Have terminated their contract with a purchaser for value\n\nreceived, until the expiration of the remainder of the term provided\n\nin such contract;\n\n3. Have terminated market sharing within the previous twelve\n\n(12) months; or\n\n4.
