Stat. tit. 52, § 52-67","heading":"Authorization for construction, siting, expansion or","body":"operation of crude oil or refined petroleum product pipeline\n\nfacilities – Schedule of approval.\n\nA. The Corporation Commission shall cooperate with and comply\n\nwith deadlines established by the Federal Energy Regulatory\n\nCommission in regards to authorization for the construction, siting,\n\nexpansion, or operation of crude oil or refined petroleum product\n\npipeline facilities.\n\nB. The Corporation Commission shall have the authority to\n\nestablish a schedule for all state pipeline authorizations with\n\nrespect to crude oil or refined petroleum product pipeline\n\nfacilities. In establishing the schedule, the Commission shall:\n\n1. Ensure expeditious completion of all proceedings; and\n\n2. Accommodate the applicable schedules established by state\n\nlaw for such proceedings.\n\nC. Any judicial appeal of the actions of the Commission shall\n\nbe to an Oklahoma court of competent jurisdiction as provided for by\n\nthe Constitution of the State of Oklahoma.\n\nD. Upon application by a qualified applicant, the Commission\n\nshall issue an order authorizing, in whole or in part, the siting,\n\nconstruction, expansion, or operation of a crude oil or refined\n\npetroleum product pipeline facility which is located in either\n\ninterstate or intrastate commerce.\n\nE. If the holder of a Commission order issued pursuant to this\n\nsection cannot acquire by contract, or is unable to agree with the\n\nowner of the property on the amount of compensation to be paid for:\n\n1. The necessary right-of-way to site, construct, operate, and\n\nmaintain a pipeline or pipelines for the transportation of crude oil\n\nor refined petroleum products; and\n\n2. The necessary land or other property for the location of\n\ncompressor stations, pressure apparatus, or other stations or\n\nequipment necessary to the proper operation of such pipeline or\n\npipelines,\n\nthe holder of the order may acquire the property through the\n\nexercise of the right of eminent domain in an Oklahoma court of\n\ncompetent jurisdiction as allowed under the Constitution of the\n\nState of Oklahoma.","path":["OK Code","Title 52"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os52.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"851da7a0b6b78328cc5ea95daad13c2d18062de7b6df9ddf644d037cf8dafb37","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-52-52-65","next":"us-ok/okla.-stat.-tit.-52-52-7"},"notice":"GroundRules: Original legal text.
