Unless specifically provided otherwise in an instrument\n\ntransferring or retaining title to the mineral estate separate from\n\nthe surface estate, and subject to, and consistent with, the\n\nprovisions of the surface damages statutes and all other applicable\n\nlaws, rules and regulations, within a tract of real property, the\n\nmineral owner has had, and shall hereafter continue to have, the\n\nright to make reasonable use of the surface estate, including the\n\nright of ingress and egress therefor, for the purpose of exploring,\n\nsevering, capturing and producing the minerals underlying the tract\n\nof real property or lands spaced or pooled therewith.\n\nB. Notwithstanding any provision in a wind or solar energy\n\nagreement in effect on, or entered into after, May 10, 2011, or the\n\nprovisions of the Oklahoma Wind Energy Development Act, as the same\n\nis in effect or hereafter amended, the lessee of a wind or solar\n\nenergy agreement or the wind energy developer shall not unreasonably\n\ninterfere with the mineral owner's right to make reasonable use of\n\nthe surface estate, including the right of ingress and egress\n\ntherefor, for the purpose of exploring, severing, capturing and\n\nproducing the minerals.\n\nC. It is the intent of the Exploration Rights Act of 2011 to\n\nconfirm the mineral owner's historical right to make reasonable use\n\nof the surface estate, including the right of ingress and egress\n\ntherefor, for the purpose of exploring, severing, capturing and\n\nproducing the minerals, and nothing in this act is intended to\n\nexpand or diminish those historical rights. Further, nothing in\n\nthis act shall amend or modify the surface damages statutes or be\n\ninterpreted to grant, expand or diminish any person's rights\n\ntherein.\n\nD. For any alleged breach or violation of the Exploration\n\nRights Act of 2011, any affected person may petition the district\n\ncourt in the county in which the real property is located for either\n\ndeclaratory relief pursuant to Sections 1651 through 1657 of Title\n\n12 of the Oklahoma Statutes, or injunctive relief pursuant to\n\nSections 1381 through 1397 of Title 12 of the Oklahoma Statutes, or\n\nboth, in addition to any other remedies at law or in equity that may\n\notherwise be available.","path":["OK Code","Title 52"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os52.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"7b9617452c238ceead5230f1cca5d71ee607e9eda0e41b07883948305f8c6c93","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-52-52-802","next":"us-ok/okla.-stat.-tit.-52-52-804"},"notice":"GroundRules: Original legal text.
