Stat. tit. 52, § 52-97","heading":"Commission - Jurisdiction to make orders, rules and","body":"regulations - Hearings.\n\nThe Commission upon its own motion, or upon the petition of the\n\nAttorney General, or of the Conservation Attorney, or of the\n\nDirector of Conservation, on behalf of the state, or of any\n\noperator, producer, or taker of oil from any common source of\n\nsupply, to be affected by any such order, rule or regulation, filed\n\nwith the Commission, shall have jurisdiction to make any and all\n\norders, rules and regulations authorized and/or provided for in\n\nSections 1 to 13 of this act, inclusive, provided that said orders,\n\nrules, and regulations shall be made only after a hearing before the\n\nCommission, of which the Commission shall have given at least ten\n\n(10) days' notice, by one publication of such notice in some\n\nnewspaper of general circulation published in Oklahoma County,\n\nOklahoma, at which hearing the Attorney General, or the Conservation\n\nAttorney or the Director of Conservation upon behalf of the state,\n\nany operator or taker or producer of oil from any common source of\n\nsupply, or any other person interested in such common source or\n\nsources of supply to be affected by the order, rule or regulation\n\nsought, shall have an opportunity to offer evidence and to be heard\n\nin support of or in opposition to such motion or petition for such\n\norder, rule, or regulation. Such notice of hearing shall be signed\n\nby at least a majority of the members of the Commission and shall\n\nspecify (a) the time and place of hearing, (b) briefly the general\n\nnature of the order or orders, rule or rules, regulation or\n\nregulations sought in the proceeding before the Commission, and (c)\n\nthe name or names or general description of the common source or\n\nsources of supply that may be affected by any such rule, order, or\n\nregulation, unless by such motion or petition filed the order or\n\norders, rule or rules, regulation or regulations sought are intended\n\nto apply and affect the entire state.\n\nWith respect to any motion or petition filed under the\n\nprovisions of this act, the service of notice thereof and any\n\nhearing thereon, and any order, rule or regulation, made thereon,\n\nthe Commission shall have the power of a court of record, and shall\n\nhave the further powers and authority with respect thereto\n\nenumerated and provided in Section 98 of this title; provided, that\n\nthe Commission upon the date set or fixed in the notice of hearing\n\nin any proceeding commenced under the provisions of this section, or\n\nat the time of such hearing therein, or of making any order or\n\norders, rule or rules, regulation or regulations therein, may by its\n\norder provide that said proceeding shall be continued upon the\n\ndocket of the Commission for further hearing or hearings therein,\n\nand for the issuance and/or promulgation of further order or orders,\n\nrule or rules, or regulation or regulations by the Commission\n\ntherein, modifying, supplementing, repealing or vacating any\n\nprevious order, rule or regulation of the Commission therein as it\n\nshall determine; and if the Commission shall, in any such order,\n\nrule or regulation continuing any such case upon its docket for\n\nfurther hearings and orders therein, fix the time and place of such\n\nhearing or hearings, no further notice thereof shall be required;\n\nbut if the Commission shall not, in its orders continuing upon its\n\ndocket any such proceeding for further hearings and orders therein,\n\nfix the time and place of such hearing or hearings, then no further\n\nhearing therein shall be had until notice thereof shall have been\n\ngiven for the same length of time and in the same manner provided in\n\nthis act for notice of the initial hearing in said proceeding.","path":["OK Code","Title 52"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os52.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"3630133b47f187d47de985e7acc72ba00c922f19921f86dabb2b043b3c5a9130","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-52-52-96","next":"us-ok/okla.-stat.-tit.-52-52-98"},"notice":"GroundRules: Original legal text.
