Stat. tit. 54, § 54-1-504","heading":"Partner's Transferable Interest Subject to Charging","body":"Order.\n\nPartner's Transferable Interest Subject to Charging Order. (a)\n\nOn application by a judgment creditor of a partner or of a partner's\n\ntransferee, a court having jurisdiction may charge the transferable\n\ninterest of the judgment debtor to satisfy the judgment. The court\n\nmay appoint a receiver of the share of the distributions due or to\n\nbecome due to the judgment debtor in respect of the partnership and\n\nmake all other orders, directions, accounts, and inquiries the\n\njudgment debtor might have made or which the circumstances of the\n\ncase may require.\n\n(b) A charging order constitutes a lien on the judgment\n\ndebtor's transferable interest in the partnership. The court may\n\norder a foreclosure of the interest subject to the charging order at\n\nany time. The purchaser at the foreclosure sale has the rights of a\n\ntransferee.\n\n(c) At any time before foreclosure, an interest charged may be\n\nredeemed:\n\n(1) by the judgment debtor;\n\n(2) with property other than partnership property, by one or\n\nmore of the other partners; or\n\n(3) with partnership property, by one or more of the other\n\npartners with the consent of all of the partners whose interests are\n\nnot so charged.\n\n(d) This act does not deprive a partner of a right under\n\nexemption laws with respect to the partner's interest in the\n\npartnership.\n\n(e) This section provides the exclusive remedy by which a\n\njudgment creditor of a partner or partner's transferee may satisfy a\n\njudgment out of the judgment debtor's transferable interest in the\n\npartnership.","path":["OK Code","Title 54"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os54.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"8ec6d674ef15b73bc56d98ec17a1fb6529e1c95a958c0b279f98f9e68b985f64","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-54-54-1-503","next":"us-ok/okla.-stat.-tit.-54-54-1-601"},"notice":"GroundRules: Original legal text.
