Stat. tit. 54, § 54-500-109A","heading":"Reservation of name","body":"\n\nRESERVATION OF NAME.\n\n(a) The exclusive right to the use of a name that complies with\n\nSection 8 of this act may be reserved by:\n\n(1) a person intending to organize a limited partnership under\n\nthe Uniform Limited Partnership Act of 2010 and to adopt the name;\n\n(2) a limited partnership or a foreign limited partnership\n\nauthorized to transact business in this state intending to adopt the\n\nname;\n\n(3) a foreign limited partnership intending to obtain a\n\ncertificate of authority to transact business in this state and\n\nadopt the name;\n\n(4) a person intending to organize a foreign limited\n\npartnership and intending to have it obtain a certificate of\n\nauthority to transact business in this state and adopt the name;\n\n(5) a foreign limited partnership formed under the name; or\n\n(6) a foreign limited partnership formed under a name that does\n\nnot comply with subsection (b) or (c) of Section 8 of this act, but\n\nthe name reserved under this paragraph may differ from the foreign\n\nlimited partnership’s name only to the extent necessary to comply\n\nwith subsections (b) and (c) of Section 8 of this act.\n\n(b) A person may apply to reserve a name under subsection (a)\n\nof this section by delivering to the Secretary of State for filing\n\nan application that states the name to be reserved and the paragraph\n\nof subsection (a) of this section which applies. If the Secretary\n\nof State finds that the name is available for use by the applicant,\n\nthe Secretary of State shall file a statement of name reservation\n\nand thereby reserve the name for the exclusive use of the applicant\n\nfor sixty (60) days.\n\n(c) An applicant that has reserved a name pursuant to\n\nsubsection (b) of this section may reserve the same name for\n\nadditional sixty-day periods. A person having a current reservation\n\nfor a name may not apply for another sixty-day period for the same\n\nname until sixty (60) days have elapsed in the current reservation.\n\n(d) A person that has reserved a name under this section may\n\ndeliver to the Secretary of State for filing a notice of transfer\n\nthat states the reserved name, the name and street and mailing\n\naddress of some other person to which the reservation is to be\n\ntransferred, and the paragraph of subsection (a) of this section\n\nwhich applies to the other person.
