Stat. tit. 56, § 56-1002","heading":"Definitions","body":"As used in the Oklahoma Medicaid Program Integrity Act:\n\n1. \"Authority\" means the Oklahoma Health Care Authority;\n\n2. \"Attorney General\" means the Attorney General of this state,\n\nhis employees or his authorized representatives;\n\n3. \"Claim\" means a communication, including written,\n\nelectronic, or magnetic, which is utilized to identify a good, item,\n\nor service as reimbursable pursuant to the Oklahoma Medicaid\n\nProgram, or which states income or expense and is or may be used to\n\ndetermine a rate of payment pursuant to the Oklahoma Medicaid\n\nProgram; and any application for payment by any person from the\n\nOklahoma Medicaid Program or its fiscal agents for each good or\n\nservice purported by any person to have been provided by any person\n\nto any Medicaid recipient;\n\n4. \"Fiscal agents\" means any individual, firm, corporation,\n\nprofessional association, partnership, organization, or other legal\n\nentity which, through a contractual relationship with the Oklahoma\n\nHealth Care Authority and, thereby, the State of Oklahoma, receives,\n\nprocesses, and pays claims under the Oklahoma Medicaid Program;\n\n5. \"Kickback\" means a return in any form by any individual,\n\ncompany, corporation, partnership, or association of a part of an\n\nexpenditure made by a provider:\n\na. to the same provider,\n\nb. to an entity controlled by the provider or,\n\nc. to an entity which the provider intends to benefit\n\nwhenever such expenditure is reimbursed, or\n\nreimbursable, or claimed by a provider as being\n\nreimbursable by the Oklahoma Medicaid Program and when\n\nthe sum or value returned is not credited to the\n\nbenefit of the Oklahoma Medicaid Program;\n\n6. \"Medicaid recipient\" means any individual in whose behalf\n\nany person claimed or received any payment or payments from the\n\nOklahoma Medicaid Program or its fiscal agents, whether or not any\n\nsuch individual was eligible for benefits under the Oklahoma\n\nMedicaid Program;\n\n7. \"Oklahoma Medicaid Program\" means the state program\n\nadministered by the Oklahoma Health Care Authority pursuant to Title\n\nXIX of the federal Social Security Act, which provides for payments\n\nfor medical goods or services on behalf of indigent families with\n\ndependent children and of aged, blind, or disabled individuals whose\n\nincome and resources are insufficient to meet the cost of necessary\n\nmedical services;\n\n8. \"Person\" means any Medicaid provider of goods or services or\n\nany employee of such provider, whether that provider is an\n\nindividual, individual medical vendor, firm, corporation,\n\nprofessional association, partnership, organization, or other legal\n\nentity under the Oklahoma Medicaid Program, or any individual,\n\nindividual medical vendor, firm, corporation, professional\n\nassociation, partnership, organization, other legal entity, or any\n\nemployee of such who is not a provider under the Oklahoma Medicaid\n\nProgram but who provides goods or services to a provider under the\n\nOklahoma Medicaid Program for which the provider submits claims to\n\nthe Oklahoma Medicaid Program or its fiscal agents;\n\n9. \"Provider\" means any person who has applied to participate\n\nor who participates in the Oklahoma Medicaid Program as a supplier\n\nof a good or a service;\n\n10. \"Records\" means all medical, professional, or business records\n\nor documents relating to the treatment or care of any recipient, or\n\nto a good or a service provided to any such recipient, or to rates\n\nor amounts paid or claimed for such a good or a service including\n\nbut not limited to records of non-Medicaid goods or services to\n\nverify rates or amounts; and any records required to be kept by the\n\nOklahoma Health Care Authority to be kept by any person; and\n\n11. \"Sign\" means to affix a signature directly or indirectly by\n\nmeans of handwriting, typewriter, signature stamp, computer impulse,\n\nor other means recognized by Oklahoma Law.","path":["OK Code","Title 56"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os56.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"60ae0c2fe5ab63c8dc640a00ae5de5625af2d9a9d1dfeb9b89ebee9255552892","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-56-56-1001","next":"us-ok/okla.-stat.-tit.-56-56-1003"},"notice":"GroundRules: Original legal text.
