It shall be unlawful and deemed a Class D1 felony offense\n\nfor any person to willfully and knowingly:\n\n1. Make or cause to be made a claim, knowing the claim to be\n\nfalse, in whole or in part, by commission or omission;\n\n2. Make or cause to be made a statement or representation for\n\nuse in obtaining or seeking to obtain authorization to provide a\n\ngood or a service knowing the statement or representation to be\n\nfalse, in whole or in part, by commission or omission;\n\n3. Make or cause to be made a statement or representation for\n\nuse by another in obtaining a good or a service under the Oklahoma\n\nMedicaid Program, knowing the statement or representation to be\n\nfalse, in whole or in part, by commission or omission;\n\n4. Make or cause to be made a statement or representation for\n\nuse in qualifying as a provider of a good or a service under the\n\nOklahoma Medicaid Program, knowing the statement or representation\n\nto be false, in whole or in part, by commission or omission;\n\n5. Charge any recipient or person acting on behalf of a\n\nrecipient, money or other consideration in addition to or in excess\n\nof rates of remuneration established under the Oklahoma Medicaid\n\nProgram;\n\n6. Solicit or accept a benefit, pecuniary benefit, or kickback\n\nin connection with goods or services paid or claimed by a provider\n\nto be payable by the Oklahoma Medicaid Program; or\n\n7. Having submitted a claim for or received payment for a good\n\nor a service under the Oklahoma Medicaid Program, fail to maintain\n\nor destroy such records as required by law or the rules of the\n\nOklahoma Health Care Authority for a period of at least six (6)\n\nyears following the date on which payment was received.\n\nAny person who violates the provisions of this section shall,\n\nupon conviction, be guilty of a Class D1 felony offense and shall be\n\npunished by imprisonment as provided for in subsections B through F\n\nof Section 20N of Title 21 of the Oklahoma Statutes.\n\nB. For the purposes of this section, a person shall be deemed\n\nto have made or caused to be made a claim, statement, or\n\nrepresentation if the person:\n\n1. Had the authority or responsibility to make the claim,\n\nstatement, or representation, to supervise those who made the claim,\n\nstatement, or representation, or to authorize the making of the\n\nclaim, statement, or representation, whether by operation of law,\n\nbusiness or professional practice, or office procedure; and\n\n2. Exercised such authority or responsibility or failed to\n\nexercise such authority or responsibility and as a direct or\n\nindirect result, the false statement was made.\n\nC. The provisions of this section shall not be construed to\n\nprohibit any payment, business arrangement or payment practice not\n\nprohibited by 42 U.S.C., Section 1320a-7b(b) or any regulations\n\npromulgated pursuant thereto or to prohibit any payment, business\n\narrangement or payment practice not prohibited by Section 1-742 of\n\nTitle 63 of the Oklahoma Statutes.\n\nD. For the purposes of this section, a person shall be deemed\n\nto have known that a claim, statement, or representation was false\n\nif the person knew, or by virtue of the person's position, authority\n\nor responsibility, had reason to know, of the falsity of the claim,\n\nstatement or representation.\n\nE. Any employee of the State Department of Health, the\n\nDepartment of Human Services or the Oklahoma Health Care Authority\n\nwho knowingly or willfully fails to promptly report a violation of\n\nthe Oklahoma Medicaid Program, subject to the provisions of this\n\nsection, to the chief administrative officer of such agency or the\n\nState Attorney General shall, upon conviction thereof, be guilty of\n\na misdemeanor.","path":["OK Code","Title 56"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os56.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"eba6608023141ae253633e030f86333fe8d37893f5843db97e3c9f45b2ee386f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-56-56-1004","next":"us-ok/okla.-stat.-tit.-56-56-1005.1"},"notice":"GroundRules: Original legal text.
