As used in this section:\n\n1. “Administrative sanction” means the court may enter an order\n\nmaking an individual who violates a provision of this section\n\nineligible for assistance for a specified period of time. Such\n\norder shall be communicated to the Oklahoma Health Care Authority\n\nLegal Division; and\n\n2. “Insure Oklahoma” means the program administered by the\n\nOklahoma Health Care Authority pursuant to Sections 1010.1 through\n\n1010.13 of Title 56 of the Oklahoma Statutes.\n\nB. Any individual who:\n\n1. Obtains or attempts to obtain, or aids, abets or assists any\n\nindividual to obtain, by means of a false statement or\n\nrepresentation, or by false impersonation, or by a fictitious\n\ntransfer, conveyance or encumbrance of property or income, or by a\n\nknowing and willful failure to report to the Department of Human\n\nServices or the Oklahoma Health Care Authority income, personal\n\nproperty, real property, household members, or other material\n\neligibility factors at the time of application or during the receipt\n\nof assistance, or by other fraudulent device, assistance to which an\n\napplicant is not entitled or assistance greater than that to which\n\nan applicant is justly entitled shall be guilty of a misdemeanor or\n\na felony;\n\n2. By sale, barter, purchase, theft, acquisition, possession or\n\nuse of any medical identification card or any other device\n\nauthorizing participation in the Oklahoma Medicaid Program,\n\nknowingly obtains, aids, abets or assists any individual to obtain\n\nor attempt to obtain assistance to which an individual is not\n\nentitled shall be guilty of a misdemeanor or a felony; or\n\n3. Attempts to obtain Medicaid or Insure Oklahoma benefits by\n\nomitting income, personal property, household members, or other\n\nmaterial eligibility factors shall, upon conviction, be guilty of a\n\nmisdemeanor punishable by either a fine of three times the amount of\n\nassistance, or up to three (3) months in the county jail. In\n\naddition, the individual may also be punished by an administrative\n\nsanction regarding Medicaid benefits. The court shall have\n\ndiscretion in determining penalties.\n\nC. If the acts in either paragraph 1 or 2 of subsection B of\n\nthis section or both paragraphs 1 and 2 of subsection B of this\n\nsection cause the Oklahoma Health Care Authority to determine that\n\nan individual or family is eligible for Medicaid or the Insure\n\nOklahoma program and the aggregate amount of assistance paid on\n\nbehalf of the individual or individuals is less than Five Thousand\n\nDollars ($5,000.00), the penalty, upon conviction, shall be a\n\nmisdemeanor punishable by fine or imprisonment, or both a fine and\n\nimprisonment for three (3) months or an administrative sanction\n\nregarding Medicaid benefits in the discretion of the court. If the\n\nacts in paragraph 1 or 2 of subsection B of this section or both\n\nparagraphs 1 and 2 of subsection B of this section cause the\n\nOklahoma Health Care Authority to determine an individual or family\n\neligible for Medicaid or the Insure Oklahoma program and the\n\naggregate amount of assistance paid on behalf of the individual or\n\nindividuals is equal to or greater than Five Thousand Dollars\n\n($5,000.00), the penalty, upon conviction, shall be a Class D1\n\nfelony offense punishable by fine or imprisonment as provided for in\n\nsubsections B through F of Section 20N of Title 21 of the Oklahoma\n\nStatutes, or both a fine and imprisonment as provided for in\n\nsubsections B through F of Section 20N of Title 21 of the Oklahoma\n\nStatutes, or an administrative sanction regarding Medicaid benefits\n\nin the discretion of the court.","path":["OK Code","Title 56"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os56.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b3c0e836b2efd7baa4ce0e87d0fd4c8bf5236a88c3396c0b655b9149658dc506","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-56-56-1005","next":"us-ok/okla.-stat.-tit.-56-56-1005.2"},"notice":"GroundRules: Original legal text.
