Any person found to have committed any violation of\n\nparagraphs 1 through 6 of subsection A of Section 1005 of this title\n\nshall be deemed guilty of Medicaid fraud.\n\nB. 1. Any person committing Medicaid fraud where the aggregate\n\namount of payments illegally claimed or received is One Thousand\n\nDollars ($1,000.00) or more shall be guilty of a felony, and upon\n\nconviction thereof shall pay a fine of not more than three times the\n\namount of payments illegally claimed or received or Ten Thousand\n\nDollars ($10,000.00) whichever is greater, or be imprisoned for not\n\nmore than three (3) years, or by both such fine and imprisonment.\n\n2. Any person committing Medicaid fraud where the aggregate\n\namount of payments illegally claimed or received is less than One\n\nThousand Dollars ($1,000.00) shall be guilty of a misdemeanor and\n\nupon conviction thereof shall pay a fine of not more than three\n\ntimes the amount of payments illegally claimed or received or One\n\nThousand Dollars ($1,000.00) whichever is greater, or imprisoned for\n\nnot more than one (1) year, or by both such fine and imprisonment.\n\nAny person who violates paragraph 7 of subsection A of Section\n\n1005 of this title shall be guilty of a felony, and upon conviction\n\nthereof shall pay a fine of not more than three times the amount of\n\npayments (claimed or received) equaling the services which would\n\nhave been reflected in the absent records or Ten Thousand Dollars\n\n($10,000.00), whichever is greater, or be imprisoned for not more\n\nthan three (3) years, or by both such fine and imprisonment.\n\nAdditionally, the person found guilty hereunder shall be liable for\n\nthe cost of the investigation, litigation, and attorney fees, which,\n\nin addition to all fines assessed, shall be deposited in the\n\nAttorney General's Medicaid Revolving Fund.","path":["OK Code","Title 56"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os56.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"9e239692cf6358b17b4112f7623512358619eabad8d20bf543eeaae7e97c4fe7","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-56-56-1005.4","next":"us-ok/okla.-stat.-tit.-56-56-1007"},"notice":"GroundRules: Original legal text.
