No provider shall be eligible for reimbursement through\n\nMedicaid or any other federal or state program, directly or by\n\nsubcontract with any other party, if:\n\n1. That provider, or any affiliate of that provider, has been\n\nfound by a court of law, either civilly or criminally, to have\n\nfailed to report statutory rape as part of mandatory potential child\n\nabuse reporting laws applicable to the medical provider, when that\n\nprovider, or the affiliate of that provider, provides services\n\nrelating to pregnancy or termination of pregnancy to that minor\n\nfemale for compensation; or\n\n2. The entity or an affiliate of the entity failed to report\n\nstatutory rape of a patient as child abuse as required by law, where\n\nthe abuser was later convicted of abusing that patient, whether or\n\nnot the entity or an affiliate of the entity was itself adjudicated\n\nof failing to report statutory rape.\n\nB.
