On or before January 1, 2011, the Oklahoma Health Care\n\nAuthority shall establish and maintain a program with a voucher\n\nand/or other subsidy to provide medical coverage assistance to\n\nchildren, eighteen (18) years of age or younger, whose family\n\nincomes are between one hundred eighty-five percent (185%) and three\n\nhundred percent (300%) of the federal poverty level.\n\nB. To be eligible for the program, the child must:\n\n1. Be a lawful resident of the State of Oklahoma;\n\n2. Be ineligible for medical assistance under the state\n\nMedicaid program; and\n\n3. Have been without health insurance coverage for a period set\n\nforth by the Authority, but not less than six (6) months during the\n\nfirst month of operation of the program, except in the following\n\nsituations:\n\na. loss of employment by a parent which made available\n\naffordable dependent health insurance coverage, until\n\nsuch time as affordable employer-sponsored dependent\n\nhealth insurance coverage is again available for the\n\nchild as set forth by the Authority,\n\nb. affordable private or employer-sponsored health\n\ninsurance is unavailable to the responsible relative\n\nof a newborn, or\n\nc. loss of medical benefits under the state Medicaid\n\nprogram within one year of applying for coverage under\n\nthe All Kids Act.\n\nC. The Authority shall provide assistance to families in\n\ngaining health care benefits for children in the program by offering\n\na voucher and/or other subsidy toward the cost of privately\n\nsponsored health insurance, including, but not limited to, employer-\n\nsponsored health insurance provided through the state’s premium\n\nassistance program.\n\nD. If privately sponsored health insurance is not available,\n\nthe Authority may allow applicants to purchase access to the state-\n\nadministered health care benefit under the premium assistance\n\nprogram.\n\nE. The Authority is authorized to offer partial coverage to\n\nchildren who are enrolled in a high-deductible private health\n\ninsurance plan or to offer a limited package of benefits to children\n\nin families who have private or employer-sponsored health insurance\n\ncoverage which does not cover certain benefits, including, but not\n\nlimited to, dental or vision benefits.\n\nF. The families of children who are enrolled in this program\n\nshall be subject to the following cost-sharing requirements:\n\n1. Cost-sharing provisions stated in privately sponsored health\n\ninsurance plans for children enrolled in such plans; and\n\n2. Cost-sharing methods and levels to be set forth by the\n\nAuthority for individuals participating in the state-administered\n\npremium assistance program. Such cost-sharing shall be on a sliding\n\nscale based on family income and may be periodically modified by the\n\nAuthority.\n\nNotwithstanding paragraphs 1 and 2 of this subsection, there\n\nshall be no co-payment required for well-baby or well-child health\n\ncare for children enrolled in the program, including, but not\n\nlimited to, age-appropriate immunizations as required under state or\n\nfederal law.\n\nG. The Authority shall promulgate rules to determine\n\neligibility and enrollment of children in the program.\n\nH. The Authority shall submit to the federal Centers for\n\nMedicare and Medicaid Services an application for any waivers or any\n\nstate plan amendments required to amend the state Medicaid plan to\n\nenact the provisions of the All Kids Act. Subject to federal\n\napproval, the program shall utilize a voucher and/or related subsidy\n\nsystem for participating families.\n\nI. Funding for this act shall be provided from the unused funds\n\nfrom the Oklahoma Employer/Employee Partnership for Insurance\n\nCoverage pursuant to Section 1010.1 of Title 56 of the Oklahoma\n\nStatutes, not to exceed Eight Million Dollars ($8,000,000.00).","path":["OK Code","Title 56"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os56.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"fd11039ae7d526b8b477e15310389d27942a97f7246389610767902ffb73e822","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-56-56-1009.1","next":"us-ok/okla.-stat.-tit.-56-56-1010.1"},"notice":"GroundRules: Original legal text.
