Stat. tit. 56, § 56-1011.2","heading":"Program to improve service delivery system - Waivers of","body":"federal laws - Implementation of phase one of act - Independent\n\nevaluation - Purpose.\n\nA. The Oklahoma Health Care Authority is authorized to seek\n\nwaivers and/or other federal authorizations to create a statewide\n\nprogram to provide for a more efficient and effective service\n\ndelivery system that enhances quality of care and client outcomes in\n\nthe Oklahoma Medicaid Program.\n\nB. The Oklahoma Health Care Authority shall develop and submit\n\nfor approval, applications for waivers of applicable federal laws\n\nand regulations as necessary to implement the provisions of the\n\nOklahoma Medicaid Reform Act of 2006. Copies of all waivers\n\nsubmitted to and approved by the United States Centers for Medicare\n\nand Medicaid Services under this section shall be provided to the\n\nLegislature within ten (10) days of their approval. The Oklahoma\n\nHealth Care Authority shall submit a plan containing a recommended\n\ntimeline for implementation of any waivers and budgetary projections\n\nof the effect of the Oklahoma Medicaid Reform Act of 2006. This\n\nimplementation plan shall be submitted to the Governor, the Speaker\n\nof the House of Representatives and the President Pro Tempore of the\n\nSenate.\n\nC. 1. For the purposes of this subsection:\n\na. “rural” means outside the corporate limits of any\n\nmunicipal corporation and includes open country,\n\nunincorporated communities, and any municipality\n\nhaving a population of ten thousand (10,000) or less\n\naccording to the latest Federal Decennial Census, and\n\nb. “urban” means any area which is not rural.\n\n2. By July 1, 2010, phase one of this act shall be implemented\n\nwithin an area of the state with rural and urban characteristics.\n\nThe Oklahoma Health Care Authority shall contract for an independent\n\nevaluation and report findings of this phase of the act to the\n\nGovernor and the Legislature. After an independent evaluation and\n\nreport to the Governor and Legislature, if it is determined that the\n\nevaluation establishes improved access to health care, improved\n\nhealth care outcomes, and improved cost efficiencies, it is the\n\nintent of the Legislature that components of the act be phased in\n\nstatewide.\n\nD. Upon this evaluation and determination of improvement by the\n\nGovernor and Legislature, the Oklahoma Health Care Authority shall\n\nnegotiate a plan for statewide expansion of the act from the Centers\n\nfor Medicare and Medicaid Services.\n\nE. The Oklahoma Health Care Authority may contract with a pay-\n\nfor-performance program provider. The purpose of the program is to\n\ntest a program’s value proposition that offers financial incentives\n\nto both the health care provider and the patient for incorporating\n\nevidence-based medicine guidelines and information therapy\n\nprescriptions in the rendering and utilizing of health care. This\n\nprogram may offer the health care provider the flexibility to use\n\nthe health care provider’s clinical judgment to adhere to or deviate\n\nfrom the program’s guidelines and still receive a financial\n\nincentive as long as the health care provider prescribes information\n\ntherapy to the patient. The program shall offer a financial reward\n\nto the patient for responding to the information therapy\n\nprescription by demonstrating the patient’s understanding of the\n\npatient’s health condition, by demonstrating adherence to\n\nrecommended care, and by judging the quality of care given to the\n\npatient against these guidelines. The program shall be offered and\n\nadministered through an Internet application. This demonstration\n\nproject shall collect and analyze data over a period of two (2)\n\nyears or other reasonable time frame in order to determine its\n\neffectiveness.\n\nF. The purpose of the Oklahoma Medicaid Reform Act of 2006 is\n\nto:\n\n1. Stabilize Medicaid expenditures in the act areas compared to\n\nMedicaid expenditures in the test areas for the three (3) years\ntered through an Internet application. This demonstration\n\nproject shall collect and analyze data over a period of two (2)\n\nyears or other reasonable time frame in order to determine its\n\neffectiveness.\n\nF. The purpose of the Oklahoma Medicaid Reform Act of 2006 is\n\nto:\n\n1. Stabilize Medicaid expenditures in the act areas compared to\n\nMedicaid expenditures in the test areas for the three (3) years\n\npreceding implementation of the act, while ensuring:\n\na. consumer education and choice,\n\nb. access to medically necessary services,\n\nc. coordination of preventative, acute, and long-term\n\ncare services, and\n\nd. reductions in unnecessary service utilization;\n\n2. Provide an opportunity to evaluate the progress of statewide\n\nimplementation of the Oklahoma Medicaid Reform Act of 2006 as a\n\nreplacement for the current Medicaid system; and\n\n3.
