Stat. tit. 56, § 56-1012.2","heading":"Definitions","body":"As used in the Commitment to Care for People with Complex\n\nPhysical Disabilities Act:\n\n1. \"Complex physical disability\" means a diagnosis or medical\n\ncondition that results in significant physical impairment and/or\n\nfunctional limitation. Such term shall include, but not be limited\n\nto, individuals with spinal cord injury, traumatic brain injury,\n\ncerebral palsy, muscular dystrophy, spina bifida, osteogenesis\n\nimperfecta, arthrogryposis, amyotrophic lateral sclerosis, multiple\n\nsclerosis, demyelinating disease, myelopathy, myopathy, progressive\n\nmuscular atrophy, anterior horn cell disease, post-polio syndrome,\n\ncerebellar degeneration, dystonia, Huntington's disease,\n\nspinocerebellar disease, and certain types of amputation, paralysis,\n\nor paresis that result in significant physical impairment and/or\n\nfunctional limitation. The term \"complex physical disability\" does\n\nnot negate the requirement that an individual meet medical necessity\n\nrequirements under Oklahoma Health Care Authority rules to qualify\n\nfor receiving complex rehabilitation technology;\n\n2. \"Complex rehabilitation technology\" (CRT) means items\n\nclassified within the Medicaid program as of January 1, 2013, as\n\ndurable medical equipment that are individually configured for\n\nindividuals to meet their specific and unique medical, physical, and\n\nfunctional needs and capacities for basic activities of daily living\n\nand instrumental activities of daily living identified as medically\n\nnecessary. Such items shall include, but not be limited to, complex\n\nrehabilitation manual and power wheelchairs and options/accessories,\n\nadaptive seating and positioning items and options/accessories, and\n\nother specialized equipment such as standing frames and gait\n\ntrainers and options/accessories;\n\n3. \"Employee\" means a person whose taxes are withheld by a\n\nqualified CRT supplier and reported to the Internal Revenue Service;\n\n4. \"Healthcare Common Procedure Coding System (HCPCS)\" means\n\nthe billing codes used by Medicare and overseen by the federal\n\nCenters for Medicare and Medicaid Services that are based on the\n\ncurrent procedural technology codes developed by the American\n\nMedical Association;\n\n5. \"Individually configured\" means a device has a combination\n\nof sizes, features, adjustments, or modifications that a qualified\n\ncomplex rehabilitation technology supplier can customize to the\n\nspecific individual by measuring, fitting, programming, adjusting,\n\nor adapting the device as appropriate so that the device is\n\nconsistent with an assessment or evaluation of the individual by a\n\nqualified health care professional and consistent with the\n\nindividual's medical condition, physical and functional needs and\n\ncapacities, body size, period of need, and intended use;\n\n6. \"Qualified complex rehabilitation technology professional\"\n\nmeans an individual who is certified as an Assistive Technology\n\nProfessional (ATP) by the Rehabilitation Engineering and Assistive\n\nTechnology Society of North America (RESNA);\n\n7. \"Qualified complex rehabilitation technology supplier\" means\n\na company or entity that:\n\na. is accredited by a recognized accrediting organization\n\nas a supplier of CRT,\n\nb. is an enrolled Medicare supplier and meets the\n\nsupplier and quality standards established for durable\n\nmedical equipment suppliers, including those for CRT,\n\nunder the Medicare program,\n\nc. employs as a W-2 employee at least one qualified CRT\n\nprofessional for each location to:\n\n(1) analyze the needs and capacities of the complex-\n\nneeds patient in consultation with qualified\n\nheath care professionals,\n\n(2) participate in the selection of appropriate CRT\n\nfor such needs and capacities, and\nfor CRT,\n\nunder the Medicare program,\n\nc. employs as a W-2 employee at least one qualified CRT\n\nprofessional for each location to:\n\n(1) analyze the needs and capacities of the complex-\n\nneeds patient in consultation with qualified\n\nheath care professionals,\n\n(2) participate in the selection of appropriate CRT\n\nfor such needs and capacities, and\n\n(3) provide technology-related training in the proper\n\nuse of the CRT,\n\nd. requires a qualified complex rehabilitation technology\n\nprofessional be physically present for the evaluation\n\nand determination of appropriate CRT,\n\ne. has the capability to provide service and repair by\n\nqualified technicians for all CRT it sells, and\n\nf. provides written information to the complex-needs\n\npatient prior to ordering CRT as to how the complex-\n\nneeds patient may receive service and repair; and\n\n8. \"Qualified health care professional\" means a health care\n\nprofessional licensed by the State Department of Health who has no\n\nfinancial relationship with a qualified complex rehabilitation\n\ntechnology supplier.
