The Oklahoma Health Care Authority is directed to create a\n\nsystem of enrollment, Medicaid eligibility, and certification for\n\nhome- and community-based services provided by the ADvantage Waiver\n\nProgram that provides for presumptive Medicaid eligibility and\n\ncertification that is the same as that which exists for nursing\n\nfacilities as provided for in administrative rules promulgated by\n\nthe Oklahoma Health Care Authority Board. The system shall\n\nfacilitate the provision of home- and community-based services to\n\npersons at risk of placement in a nursing facility but who elect to\n\nbe served in a home- and community-based setting in lieu of nursing\n\nfacility services.\n\nB. The Department of Human Services is directed to make such\n\nchanges in its regulations, policies and procedures as are necessary\n\nto implement the enrollment, Medicaid eligibility, and certification\n\nrequirements established pursuant to subsection A of this section.\n\nC. The Oklahoma Health Care Authority shall develop and submit\n\nfor approval no later than November 1, 2011, applications for\n\nwaivers or amendments to waivers of applicable federal laws and\n\nregulations as necessary to implement the provisions of the Oklahoma\n\nChoices for Long-Term Care Act. Copies of all waivers submitted to\n\nthe United States Centers for Medicare and Medicaid Services shall\n\nbe provided to the Governor, the Speaker of the Oklahoma House of\n\nRepresentatives and the President Pro Tempore of the Oklahoma State\n\nSenate within ten (10) days of their submissions. Waivers and\n\namendments to waivers approved by the United States Centers for\n\nMedicare and Medicaid Services as provided in this section shall be\n\nprovided to the Governor, the Speaker of the Oklahoma House of\n\nRepresentatives and the President Pro Tempore of the Oklahoma State\n\nSenate within ten (10) days of their approval. The Oklahoma Health\n\nCare Authority shall implement any waivers and amendments to waivers\n\napproved by the United States Centers for Medicare and Medicaid\n\nServices no later than January 1, 2012, or within sixty (60) days of\n\ntheir approval.
