Stat. tit. 56, § 56-1017.6","heading":"Options counseling for long-term care for persons 55 or","body":"older.\n\nA. As used in this section, \"Program of All-Inclusive Care for\n\nthe Elderly (PACE)\" means a full risk-bearing program that provides\n\ncomprehensive health services for individuals age fifty-five (55)\n\nand over who are sufficiently frail to be categorized as nursing\n\nhome eligible by the state's Medicaid program. PACE shall be\n\nreimbursed on a fixed per-member per-month rate and, in return for\n\nsuch fixed payment, is responsible for providing all health\n\nservices, including transportation.\n\nB. 1. Persons who are fifty-five (55) years of age or older,\n\nor their legal guardians or lay caregivers, shall receive options\n\ncounseling for long-term care as defined in Section 3002.7 of Title\n\n56 of the Oklahoma Statutes prior to admission to a long-term care\n\nfacility, except in the case of an emergency admission. Options\n\ncounseling shall include, but not be limited to, PACE, if so\n\napplicable, nursing facilities and home- and community-based\n\nservices.\n\n2. In the case of an emergency admission, the options\n\ncounseling for long-term care shall take place within fourteen (14)\n\ndays of the emergency admission or as soon as is reasonably\n\npossible.\n\n3. Persons who are fifty-five (55) years of age or older and\n\nlive within the defined service area of a PACE provider shall\n\nreceive information regarding PACE as part of options counseling for\n\nlong-term care as defined in Section 3002.7 of Title 56 of the\n\nOklahoma Statutes.\n\n4. Any person currently residing in a nursing facility shall be\n\nable to receive options counseling for long-term care as defined in\n\nSection 3002.7 of Title 56 of the Oklahoma Statutes at the person's,\n\nor their legal guardian's or lay caregiver's, request or at the time\n\nof any reevaluation or renewal of long-term care. Nothing in this\n\nsection shall require any person currently residing in a nursing\n\nfacility to receive options counseling if they do not desire to do\n\nso.\n\nC.
