As used in this section:\n\n1. “PACE” stands for programs of all-inclusive care for the\n\nelderly; and\n\n2. The terms “PACE program agreement”, “PACE organization”,\n\n“participant” and “state administering agency” have the same meaning\n\nas provided by 42 C.F.R., Section 460.6.\n\nB. The Oklahoma Health Care Authority shall serve as the state\n\nadministering agency responsible for administering PACE program\n\nagreements under 42 C.F.R., Part 460, Subpart C.\n\nC. The Authority shall enforce the federal regulations of the\n\nCenters for Medicare and Medicaid Services governing PACE codified\n\nat 42 C.F.R., Part 460. The Authority shall have all the powers and\n\nduties provided to the state administering agency under 42 C.F.R.,\n\nPart 460.\n\nD. PACE organizations shall be exempt from licensure by the\n\nState Department of Health under the Home Care Act, the Adult Day\n\nCare Act, or any other act that governs a different type of facility\n\nor provider. This subsection shall not be construed to prevent the\n\nDepartment from enforcing such acts with respect to facilities or\n\nproviders contracted by the PACE organization to provide services to\n\nPACE program participants.\n\nE. The Authority may, as necessary, execute an interagency\n\nagreement with the State Department of Health to carry out any of\n\nthe functions of the state administering agency under 42 C.F.R.,\n\nPart 460.\n\nF.
