Stat. tit. 56, § 56-1020","heading":"Community-based program of services - Administration -","body":"Gifts.\n\nA. The Director of the Department of Human Services shall,\n\nwithin the constraints of funding appropriated to the Department,\n\nestablish and maintain a community-based program of services that\n\nincludes, but is not limited to, establishment of foster care and\n\nsupported living arrangements for persons affected by Prader-Willi\n\nsyndrome. The purpose of this section of law shall be to improve\n\nthe quality of life of persons with developmental disabilities and\n\nto integrate such persons into the mainstream of society by ensuring\n\navailability of community services.\n\nB. The programs established pursuant to this section shall be\n\nadministered by the Developmental Disabilities Service Division.\n\nThe Commission for Human Services shall promulgate rules for the\n\noperation of community-based programs for persons with developmental\n\ndisabilities including, but not limited to, rules regarding the\n\ndelivery of:\n\n1. Health-related services. As used in this section, health-\n\nrelated services means services provided by community services\n\nproviders or community services workers to persons with\n\ndevelopmental disabilities, and includes, but is not limited to:\n\na. personal hygiene,\n\nb. transferring,\n\nc. range of motion,\n\nd. supervision or assistance with activities of daily\n\nliving,\n\ne. basic nursing care, such as taking the person's\n\ntemperature, pulse or respiration, positioning,\n\nincontinent care, and identification of signs and\n\nsymptoms of disease. Certain tasks that may be\n\nperformed as basic nursing care by community services\n\nworkers require appropriate training provided or\n\napproved by the Department, written agreement by the\n\nservice recipient's personal support team, and the\n\nprimary care physician's acknowledgment and specific\n\norder related to the task. Under such circumstances,\n\nbasic nursing care may include, but need not be\n\nlimited to:\n\n(1) nutrition, including meals by gastrostomy tube or\n\njejunostomy tube,\n\n(2) blood glucose monitoring,\n\n(3) ostomy bag care,\n\n(4) oral suctioning, and\n\n(5) administration of oral metered dose inhalers and\n\nnebulizers;\n\n2. Supportive assistance, which means the service rendered to\n\npersons with developmental disabilities that is sufficient to enable\n\nsuch person to meet an adequate level of daily living. Supportive\n\nassistance includes, but is not limited to, training and supervision\n\nof persons with developmental disabilities, assistance in\n\nhousekeeping, assistance in the preparation of meals, and assistance\n\nin activities of daily living as necessary for the health and\n\ncomfort of persons with developmental disabilities; and\n\n3. Safe storage and administration of medications, first aid\n\ntreatments and nutrition by oral, rectal, vaginal, otic, ophthalmic,\n\nnasal, skin, topical, transdermal and gastrostomy tube routes by\n\ncommunity service workers who have successfully completed\n\ncompetency-based training approved by the Department.\n\nC. The Department shall undertake to identify and utilize any\n\nand all federal funding which may be available for such services.\n\nD. The Department is authorized to accept any gift of real or\n\npersonal property made for the use or benefit of any program or\n\nservices established pursuant to this section. Such gift may only\n\nbe utilized for the purpose or purposes for which it is given.\n\nE. The Department shall be the agency responsible for annual\n\nperformance audits of community-based services provided through Home\n\nand Community-Based Medicaid Waivers. The Oklahoma Health Care\n\nAuthority (OHCA) shall be responsible for auditing claims to confirm\n\nthat the services billed by contract providers have been delivered\n\nper requirements from the Centers for Medicare and Medicaid Services\n\n(CMS).","path":["OK Code","Title 56"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os56.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c1912dfba43f0dcc27d4d354ff8ececdee15d04d5c0a6018b4800ac5c1ea5e61","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-56-56-1018","next":"us-ok/okla.-stat.-tit.-56-56-1025.1"},"notice":"GroundRules: Original legal text.
