Stat. tit. 56, § 56-1025.1","heading":"Definitions","body":"For the purposes of Sections 1025.2 through 1025.4 of this\n\ntitle:\n\n1. “Administrative information” means information reported to\n\nor obtained by the Department of Human Services regarding the\n\ncommunity services provider during the investigative process that\n\nmay be appropriate for internal administrative action but does not\n\nhave the potential to impact the immediate health, safety or welfare\n\nof recipients of community services, has not been verified as true\n\nand is for informational purposes only;\n\n2. “Area of concern” means an issue that does not rise to the\n\nlevel of abuse or neglect but may constitute a possible deficiency,\n\nirregularity or deviation from policies and best practices by the\n\ncommunity services provider which has the potential to impact the\n\nhealth, safety or welfare of recipients of community-based services,\n\nand the Department of Human Services has conducted sufficient\n\ninquiry into the issue to meet the probable cause investigative\n\nstandard;\n\n3. “Bureau” means the Oklahoma State Bureau of Investigation;\n\n4. “Community services provider” means a community-based\n\nprogram, corporation, or individual who contracts with, or is\n\nlicensed or funded by, the Department of Human Services to provide\n\nresidential or vocational services through in-person supports or\n\nthrough the use of remote supports to persons who are elderly or\n\npersons with intellectual or developmental disabilities, or\n\ncontracts with the Oklahoma Health Care Authority to provide\n\nservices to individuals with intellectual disabilities through a\n\nHome and Community-Based Waiver, except a private ICF/IID;\n\n5. “Community services worker” means any person employed by or\n\nunder contract with a community services provider who provides, for\n\ncompensation or as a volunteer, health-related services, training,\n\nor supportive assistance to persons who are elderly or persons with\n\ndevelopmental disabilities, and who is not a licensed health\n\nprofessional or any person who contracts with the Oklahoma Health\n\nCare Authority to provide specialized foster care, habilitation\n\ntraining specialist services, or homemaker services to persons with\n\ndevelopmental disabilities;\n\n6. “Department” means the Department of Human Services;\n\n7. “Developmental disability” means a severe, chronic\n\ndisability of a person which:\n\na. is attributable to a mental or physical impairment or\n\ncombination of mental and physical impairments, such\n\nas an intellectual development disorder, cerebral\n\npalsy, or autism,\n\nb. is manifested before the person attains twenty-two\n\n(22) years of age,\n\nc. is likely to continue indefinitely,\n\nd. results in substantial functional limitations in three\n\nor more of the following areas of major life activity:\n\n(1) self-care,\n\n(2) receptive and expressive language,\n\n(3) learning,\n\n(4) mobility,\n\n(5) self-direction,\n\n(6) capacity for independent living, and\nal\n\npalsy, or autism,\n\nb. is manifested before the person attains twenty-two\n\n(22) years of age,\n\nc. is likely to continue indefinitely,\n\nd. results in substantial functional limitations in three\n\nor more of the following areas of major life activity:\n\n(1) self-care,\n\n(2) receptive and expressive language,\n\n(3) learning,\n\n(4) mobility,\n\n(5) self-direction,\n\n(6) capacity for independent living, and\n\n(7) economic self-sufficiency, and\n\ne. reflects the person’s need for a combination and\n\nsequence of special, interdisciplinary, or generic\n\ncare, treatment, or other services which are of\n\nlifelong or extended duration and are individually\n\nplanned and coordinated;\n\n8. “Health-related services” means those services provided by\n\ncommunity services providers or community services workers to\n\npersons who are elderly or persons with developmental disabilities\n\nthat include, but are not limited to, personal hygiene,\n\ntransferring, range of motion, supervision or assistance in\n\nactivities of daily living, basic nursing care such as taking\n\ntemperature, pulse or respiration, positioning, incontinent care,\n\nand identification of signs and symptoms of disease. Certain tasks\n\nthat may be performed as basic nursing care by community services\n\nworkers require appropriate training provided or approved by the\n\nDepartment, written agreement by the service recipient’s personal\n\nsupport team, and the primary care physician’s acknowledgement and\n\nspecific order related to the task. Under such circumstances, basic\n\nnursing care may include, but need not be limited to:\n\na. nutrition including meals by gastrostomy tube or\n\njejunostomy tube,\n\nb. blood glucose monitoring,\n\nc. ostomy bag care,\n\nd. oral suctioning, and\n\ne. administration of oral metered dose inhalers and\n\nnebulizers;\n\n9. “Supportive assistance” means the service rendered to\n\npersons with developmental disabilities which is sufficient to\n\nenable such person to meet an adequate level of daily living.\n\nSupportive assistance includes, but is not limited to, training,\n\nsupervision, assistance in housekeeping, assistance in the\n\npreparation of meals, and assistance in activities of daily living\n\nas necessary for the health and comfort of persons with\n\ndevelopmental disabilities;\n\n10. “Remote supports” means the utilization of technology by\n\ncommunity services workers who are in remote locations, away from\n\nthe residences or locations of individuals with developmental or\n\nintellectual disabilities, to provide health-related services or\n\nsupportive assistance to those individuals. Communication with\n\nindividuals with developmental or intellectual disabilities shall be\n\nachieved with the use of two-way communications by community\n\nservices workers through such means as telephone or video feeds;\n\n11. “Maltreatment” means abuse, verbal abuse, sexual abuse,\n\nneglect, financial neglect, exploitation or sexual exploitation of\n\nvulnerable adults as defined in Section 10-103 of Title 43A of the\n\nOklahoma Statutes or abuse, neglect, sexual abuse or sexual\n\nexploitation of children as defined in Section 1-1-105 of Title 10A\n\nof the Oklahoma Statutes;\n\n12. “Personal care” means a level of assistance provided in the\n\nhome of an individual to meet the individual’s activities of daily\n\nliving needs such as bathing, grooming, meal preparation, light\n\nhousekeeping, laundry, and care plan-directed errands;\n\n13. “Medicaid personal care services provider” means a program,\n\ncorporation or individual who provides services under the state\n\nMedicaid personal care program or ADvantage Waiver Program to\n\nindividuals who are elderly or who have a physical disability;\n\n14. “Medicaid personal care assistant” means a person who\n\nprovides Medicaid services funded under the state Medicaid personal\n\ncare program, who is not a certified nurse aide or a licensed\n\nprofessional;\n\nnder the state\n\nMedicaid personal care program or ADvantage Waiver Program to\n\nindividuals who are elderly or who have a physical disability;\n\n14. “Medicaid personal care assistant” means a person who\n\nprovides Medicaid services funded under the state Medicaid personal\n\ncare program, who is not a certified nurse aide or a licensed\n\nprofessional;\n\n15. “Specialized foster care” means the home- and community-\n\nbased service as defined in the 1915(c) waiver approved by the\n\nCenters for Medicare and Medicaid Services;\n\n16. “Habilitation training specialist services” means the home-\n\nand community-based service as defined in the 1915(c) waiver\n\napproved by the Centers for Medicare and Medicaid Services; and\n\n17. “Homemaker services” means the home- and community-based\n\nservice as defined in the 1915(c) waiver approved by the Centers for\n\nMedicare and Medicaid Services.","path":["OK Code","Title 56"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os56.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"1fccbdb841d733edfa658af00269dd819aee4d21f0fff5652b39f722bd2b9538","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-56-56-1020","next":"us-ok/okla.-stat.-tit.-56-56-1025.2"},"notice":"GroundRules: Original legal text.
