The Director of Human Services shall promulgate rules to\n\nestablish and maintain a community services worker registry. Such\n\nrules may include, but need not be limited to:\n\n1. A procedure for notation in such registry of a final\n\ninvestigative finding by the Office of Client Advocacy within the\n\nState Department of Health or a finding by an Administrative Law\n\nJudge of maltreatment of an individual by a community services\n\nworker or a Medicaid personal care assistant;\n\n2. A procedure for notice and due process for a community\n\nservices worker, or a Medicaid personal care assistant, or applicant\n\nbefore the entering of such person’s name in the registry as having\n\na final Office of Client Advocacy investigative finding or\n\nAdministrative Law Judge finding of maltreatment of an individual;\n\n3. Disclosure requirements for information in the registry; and\n\n4. Procedures for granting a waiver of the provisions of\n\nparagraph 1 of subsection G of Section 1025.2 of this title by the\n\nDirector of Human Services.\n\nB. The community services worker registry shall include, but\n\nnot be limited to, the following information on each community\n\nservices worker and each Medicaid personal care assistant:\n\n1. The individual’s full name;\n\n2. Information necessary to identify each individual;\n\n3. The date the individual’s name was placed in the registry;\n\nand\n\n4. Information on any final Office of Client Advocacy\n\ninvestigative finding or Administrative Law Judge finding of\n\nmaltreatment concerning the worker.\n\nC. The Office of Client Advocacy shall promptly report final\n\ninvestigative findings to the Department of Human Services for the\n\npurposes of the community services worker registry.\n\nD. A community services worker, a Medicaid personal care\n\nassistant, or applicant who is adversely affected by an\n\nAdministrative Law Judge finding of maltreatment of an individual\n\nmay seek judicial review pursuant to Article II of the\n\nAdministrative Procedures Act. The finding of the Administrative\n\nLaw Judge may be appealed to the district court of the county in\n\nwhich the community services worker, Medicaid personal care\n\nassistant, or applicant resides within thirty (30) days of the date\n\nof the decision. A copy of the petition shall be served by mail\n\nupon the general counsel of the Department of Human Services.\n\nE. An investigation conducted under Section 1025.1 et seq. of\n\nthis title shall include a process for notifying a community\n\nservices provider of areas of concern and administrative\n\ninformation. An area of concern or administrative information shall\n\nnot be considered final investigative findings, nor shall the area\n\nof concern or administrative information be included in a final\n\ninvestigative report of the Office of Client Advocacy.
