Stat. tit. 56, § 56-1030.2","heading":"Notice and hearing - Appointment of receiver -","body":"Reimbursement of receiver - Liability for debts - Competitive\n\nbidding not required.\n\nA. The court shall hold a hearing within five (5) days of the\n\nfiling of the petition. The petition and notice of the hearing\n\nshall be served by the petitioner on the owner, administrator or\n\ndesignated agent of the agency, and the Oklahoma Health Care\n\nAuthority. The petition and notice shall be posted in a conspicuous\n\nplace in the agency not later than three (3) days before the time\n\nspecified for the hearing, unless a different time limit is fixed by\n\norder of the court.\n\nB. The court may appoint a receiver ex parte pending the\n\nhearing if the Department of Human Services provides testimony,\n\nunder oath, that there has been a loss of life or a life-endangering\n\nsituation exists for which an adequate remedy at law does not exist.\n\nFollowing the hearing on the petition, and upon a determination that\n\nthe appointment of a receiver is warranted, the court may then\n\nappoint a different receiver or extend the term of the ex parte\n\nreceiver.\n\nC. When the operating revenue of a residential agency in\n\nreceivership is insufficient to meet its operating expenses,\n\nincluding the cost of bringing the agency and residences into\n\ncompliance with state or federal laws or rules or regulations or\n\nprovisions of the agency's contract, or to protect the health and\n\nsafety of the residents, the operator shall be deemed insolvent.\n\nThe Department of Human Services may reimburse the receiver for\n\nthose expenses from funds available for such uses and expenses.\n\nD. The receiver, the Department of Human Services and the\n\nOklahoma Health Care Authority are not liable for debts incurred by\n\nthe owner or operator of an agency providing community residential\n\nservices for which a receiver has been appointed.\n\nE.
