Assistance shall be given under this act:\n\n1. To any needy person who has attained the age of sixty-five\n\n(65) years; provided, however, that when authorized by federal law\n\nor regulations, and in conformity therewith, the age requirement for\n\nneedy persons under this act shall be sixty-two (62) years. In\n\naddition to the above age requirements, said needy person shall\n\npossess the following qualifications:\n\na. shall be residing in this state with intent to remain\n\nin the state at the time assistance is received,\n\nb. has not sufficient income or other resources to\n\nprovide for himself or herself,\n\nc. is not an inmate of a public institution as defined by\n\nthe Oklahoma Commission for Human Services, and\n\nd. has not made an assignment, transfer or encumbrance of\n\nproperty for the purpose of rendering himself or\n\nherself eligible for assistance under this act, at any\n\ntime within five (5) years immediately preceding the\n\nfiling of an application for assistance;\n\n2. To any needy person who is blind and who possesses the\n\nfollowing qualifications:\n\na. shall be residing in this state with intent to remain\n\nin this state at the time assistance is received,\n\nb. has not sufficient income or other resources to\n\nprovide for himself or herself,\n\nc. is not an inmate of a public institution as defined by\n\nthe Oklahoma Commission for Human Services,\n\nd. has not made an assignment, transfer or encumbrance of\n\nproperty so as to render himself or herself eligible\n\nfor assistance under this act at any time within five\n\n(5) years immediately preceding the filing of an\n\napplication for assistance, and\n\ne. shall not, during the period of receiving assistance,\n\nsolicit alms;\n\n3. To any child possessing the following qualifications:\n\na. is crippled or is suffering from conditions which may\n\nlead to crippling,\n\nb. is in need of medical, surgical, corrective or other\n\nservices and care,\n\nc. has not sufficient income or other resources to\n\nprovide such medical, surgical, corrective or other\n\nservices and care,\n\nd. has no relatives who are financially able and who are\n\nrequired by law to provide such services and care,\n\ne. shall be residing in this state with intent to remain\n\nin the state at the time assistance is received, and\n\nf. who is not receiving adequate aid under other\n\nprovisions of law;\n\n4. To or on behalf of any dependent child who is under the age\n\nof eighteen (18) years of age or will graduate from high school\n\nprior to reaching nineteen (19) years of age and who possesses the\n\nfollowing qualifications:\n\na. shall be residing in this state with intent to remain\n\nin the state at the time assistance is received,\n\nb. has been deprived of parental support or care by\n\nreason of the death, continued absence from the home,\n\nor physical or mental incapacity of a parent, and who\n\nis living with a relative of the proper degree as\n\ndesignated by the Commission for Human Services in a\n\nplace of residence maintained by one or more of such\n\nrelatives as his or their own home,\n\nc. has not sufficient income or other resources to\n\nprovide for himself, and\n\nd. is a resident of the state at the time of receiving\n\nassistance.\n\nAs an incentive to accept employment, an amount as established\n\nby the Commission for Human Services may be disregarded in the\n\ndetermination of the amount of earned income to be considered\n\nagainst the grant of aid to families with dependent children.\n\nIncapacitated parents of dependent children and all other\n\ndisabled persons receiving public assistance from the Department of\n\nHuman Services, who, considering age, degree of incapacity, and\n\nability to work, appear to be able to return to a status of self-\n\nsupport through surgery, medical treatment, vocational training, and\n\nselective placement, or any one or any combination of these\n\nservices, shall be referred to the State Department of\nnd all other\n\ndisabled persons receiving public assistance from the Department of\n\nHuman Services, who, considering age, degree of incapacity, and\n\nability to work, appear to be able to return to a status of self-\n\nsupport through surgery, medical treatment, vocational training, and\n\nselective placement, or any one or any combination of these\n\nservices, shall be referred to the State Department of\n\nRehabilitation Services, and encouraged to accept such\n\nrehabilitation services as may be available to them. The Department\n\nof Human Services and the State Department of Rehabilitation\n\nServices are directed to jointly formulate an agreement for the\n\norderly referral of such cases, and the prevention of duplication of\n\neffort and expense, and the full implementation of this policy, such\n\nagreement to become effective when approved by the Oklahoma Public\n\nWelfare Commission and the Commission for Rehabilitation Services;\n\nprovided that, in cases where either parent would be required to\n\nsupport such child or children except for his or her physical\n\nincapacity, it is the duty of the Director of the Department of\n\nHuman Services to furnish the name of such parent to the State\n\nDepartment of Rehabilitation Services. The State Department of\n\nRehabilitation Services shall review the available medical and\n\nsocial information and shall contact such parent, if it can be\n\nascertained that he or she can be rehabilitated. If such parent\n\nrefuses to allow an examination by the State Department of\n\nRehabilitation Services, the State Department of Rehabilitation\n\nServices shall so notify the Director of the Department of Human\n\nServices and the children of such parent may be immediately removed\n\nfrom the welfare rolls. If said parent submits to examination and\n\nit is found that he or she can be rehabilitated, the State\n\nDepartment of Rehabilitation Services shall proceed to rehabilitate\n\nhim or her. If said parent refuses to submit himself or herself for\n\nrehabilitation, whether by medical treatment or otherwise, said\n\nservice shall so certify to the Director of the Department of Human\n\nServices who may immediately order the children of said parent\n\nremoved from the welfare rolls; and\n\n5. To any needy person who is permanently and totally disabled\n\nand who possesses the following qualifications:\n\na. shall be residing in this state with intent to remain\n\nin the state at the time assistance is received,\n\nb. has not sufficient income or other resources to\n\nprovide for himself or herself; provided, that the\n\nresources or income of a person's parents shall be\n\nconsidered in determining his or her eligibility for\n\nassistance for persons under eighteen (18) years of\n\nage; provided further, that no person shall be\n\neligible to receive assistance under this subsection\n\nfor any period of time with respect to which he or she\n\nreceives assistance under any other provision of the\n\nsection of which this subsection is a part,\n\nc. is not an inmate of a public institution as defined by\n\nthe Oklahoma Commission for Human Services, and\n\nd. has not made an assignment, transfer or encumbrance of\n\nproperty so as to render himself or herself eligible\n\nfor assistance under this act, at any time within five\n\n(5) years immediately preceding the filing of an\n\napplication for assistance.\n\nB. Eligibility for assistance under provisions of this\n\nsubsection shall be determined under rules promulgated, from time to\n\ntime, by the Department of Human Services as provided by law.\n\nAdded by State Question No. 226, Initiative Petition No. 155, § 4,\n\nadopted July 7, 1936.
