The amount of assistance which any person shall receive\n\nunder the provisions of this act shall be determined with due regard\n\nto the resources, to income and need of the individual and other\n\nconditions existing in each case and in accordance with funds\n\navailable and rules of the Commission for Human Services, but in no\n\ncase shall it be an amount which, when added to the income of the\n\napplicant from all other sources, is more than necessary to provide\n\nsuch person with reasonable subsistence compatible with decency and\n\nhealth.\n\n2. The cash or loan value of all life insurance policies, and\n\nall revocable and irrevocable contracts for prepaid funeral\n\nbenefits, as defined by Sections 6121 through 6135 of Title 36 of\n\nthe Oklahoma Statutes, and all monies set aside in a separate\n\naccount and specifically designated for funeral expenses of an\n\napplicant for and recipient of public assistance shall be considered\n\nas a resource available to meet the needs of the applicant.\n\nHowever, the following accruals by the applicant for and recipient\n\nof public assistance shall not be considered:\n\na. One Thousand Five Hundred Dollars ($1,500.00) cash\n\nvalue of the policies or revocable contracts or\n\ndesignated accounts or any combination thereof,\n\nprovided the cash value does not exceed One Thousand\n\nFive Hundred Dollars ($1,500.00), or\n\nb. Ten Thousand Dollars ($10,000.00) plus accrued\n\ninterest in an irrevocable contract, designated\n\naccount or cash value in insurance policies, or Ten\n\nThousand Dollars ($10,000.00) plus accrued interest in\n\nany combination of irrevocable account, designated\n\naccount, or cash value in insurance policies.\n\n3. If the recipient receives any money from the policies or\n\nrevocable contracts or designated accounts before the recipient's\n\ndeath, the amount received shall be considered as a resource\n\navailable to meet the recipient's needs, provided, that an amount\n\nnot to exceed One Thousand Five Hundred Dollars ($1,500.00) from all\n\npolicies may be used for prepaid burial expenses of the recipient.\n\nB. It shall be the duty of the Commission for Human Services,\n\nin conformity with the Federal Social Security Laws and in regard to\n\nfunds available, to revise and liberalize the budget as now used in\n\nascertaining the need of any person eligible to receive assistance,\n\nand, in so doing, the increased cost of living and condition of\n\nhealth of such person shall be given due consideration.\n\nC. 1. Except as otherwise provided in this subsection, the\n\nlimitations specified pursuant to paragraph 2 of subsection A of\n\nthis section shall apply to the cash or loan value of all life\n\ninsurance policies and all revocable and irrevocable contracts for\n\nprepaid funeral benefits and all monies set aside in a separate\n\naccount and specifically designated for funeral expenses of an\n\napplicant for or recipient of public assistance which were entered\n\ninto or created prior to July 1, 1986, and on and after July 1,\n\n1985.\n\n2. Any person who entered into an irrevocable life insurance\n\npolicy or irrevocable contract for prepaid funeral expenses prior to\n\nJuly 1, 1986, which exceeds the maximum limitation specified by\n\nparagraph 2 of subsection A of this section, and who is receiving\n\nassistance on July 1, 1986, is eligible to continue to receive such\n\nassistance provided such recipient does not add to or otherwise\n\nincrease such irrevocable policy or contract.\n\nAdded by State Question No. 226, Initiative Petition No. 155, § 5,\n\nadopted July 7, 1936.
