Stat. tit. 56, § 56-189a","heading":"Board of county commissioners to furnish adequate","body":"quarters - Construction or rental agreements - Lease or lease-\n\npurchase of private space and facilities.\n\nA. 1. The board of county commissioners in each county shall\n\nfurnish quarters for the local units of the Department of Human\n\nServices. Such quarters shall be located in the county courthouse\n\nor other suitable building in the county seat and shall be furnished\n\nwith light, heat and water and adequate toilet facilities. The\n\ncounty excise board shall provide adequate appropriations to enable\n\nthe county commissioners to comply with the provisions of this\n\nsubsection.\n\n2. If no suitable quarters or adequate facilities are available\n\nin the county courthouse or in the county seat, facilities shall be\n\nfurnished and supplied in the city or town in the county, but not\n\nthe county seat thereof, having the greatest population.\n\n3. The Department may enter into an agreement with the board of\n\ncounty commissioners for financial participation, by the Department,\n\nin the payment of rent on space leased for use by the Department, or\n\nin the cost of repairs of buildings or space used by the Department,\n\nor the cost of janitorial services and utility services, if the\n\nCommission for Human Services determines that such payment is\n\nnecessary for adequate space for units of the Department and that\n\nmonies for such purpose are available without detriment to programs\n\nadministered by the Department.\n\nB. 1. If the Commission for Human Services determines that\n\nadequate or suitable quarters, office space or facilities for the\n\nlocal units of the Department are not obtainable, the Department may\n\nenter into an agreement with the board of county commissioners of\n\nthe county, or with any state agency or public trust, for the\n\nconstruction or renovation of a building or buildings where local\n\nunits of the Department may have quarters, office space or\n\nfacilities; or may enter into a lease agreement for the rental of\n\nspace and facilities in a building or buildings constructed or\n\nrenovated by the county, or a state agency, public trust or building\n\nauthority, for the purpose of providing office space to the\n\nDepartment or any other public agency or agencies.\n\n2. The Department shall not enter into any agreement under the\n\nprovisions of this subsection unless federal financial participation\n\nis obtainable. All such agreements shall contain provisions as to\n\nfinancial participation therein by the parties to the agreement,\n\npayments to be made for the use or occupancy of the office space and\n\nfacilities, and ownership of the building or buildings after payment\n\nof the cost of construction or renovation thereof has been\n\ncompleted, consistent with the requirements necessary for the\n\nDepartment to obtain or receive federal funds for such purpose.\n\nC. If the Commission for Human Services determines that\n\nadequate or suitable quarters, office space or facilities for local\n\nunits of the Department are not obtainable from the board of county\n\ncommissioners of the county, or from any state agency or public\n\ntrust or building authority pursuant to the provisions of subsection\n\nB of this section, the Commission may enter into a lease agreement\n\nfor the rental of space and facilities in a building or buildings\n\nowned or operated by a private vendor for the purpose of providing\n\nsuch quarters, office space or facilities.\n\nD. The Commission for Human Services is authorized to enter\n\ninto agreements necessary to establish and determine the location of\n\na North Tulsa field office if the Commission determines that state\n\noffice space available through the Office of Management and\n\nEnterprise Services in Tulsa County is not appropriate and adequate\n\nto offer accessible and comprehensive services to clients of the\n\nDepartment of Human Services from North Tulsa County and Southern\n\nOsage County communities.\nTulsa field office if the Commission determines that state\n\noffice space available through the Office of Management and\n\nEnterprise Services in Tulsa County is not appropriate and adequate\n\nto offer accessible and comprehensive services to clients of the\n\nDepartment of Human Services from North Tulsa County and Southern\n\nOsage County communities.\n\nE. If the Commission for Human Services determines that\n\nadequate or suitable quarters, office space or facilities for local\n\nunits of the Department are not obtainable by lease agreement from\n\nthe board of county commissioners of the county, from any state\n\nagency or public trust or building authority, or from a private\n\nvendor, the Commission for Human Services may acquire real property\n\nfor such local units by lease-purchase agreement. The Department is\n\nfurther authorized to enter into lease-purchase agreements to\n\nconstruct or renovate adequate or suitable quarters, office space or\n\nfacilities needed by the Department.
