Stat. tit. 56, § 56-198.11","heading":"Oklahoma Consumer-Directed Personal Assistance and","body":"Support Services (Oklahoma CD-PASS) Act – Purposes – Legislative\n\nfindings.\n\nA. Sections 1 and 2 of this act shall be known and may be cited\n\nas the “Oklahoma Consumer-Directed Personal Assistance and Support\n\nServices (Oklahoma CD-PASS) Act”.\n\nB. The purposes of the Oklahoma Consumer-Directed Personal\n\nAssistance and Support Services Act are to:\n\n1. Provide assistance, on a voluntary basis, to families with a\n\nMedicaid-eligible member who requires long-term support services, or\n\nto provide assistance to Medicaid-eligible individuals who require\n\nlong-term support services, so that such persons may remain in their\n\nfamily residence or in their own home; and\n\n2. Afford, on a voluntary basis, frail elderly individuals and\n\nadults with disabilities who are Medicaid-eligible and who need\n\nbasic assistance with mobility, self-care and health maintenance,\n\nthe ability to have maximum control over the selection of persons\n\nworking on their behalf and over the manner in which personal\n\nassistance services are to be provided to them.\n\nC. The Oklahoma Legislature finds that:\n\n1. Providing services to individuals needing in-home and\n\ncommunity-based care, as well as providing assistance to their\n\nfamily members, should be supported;\n\n2. Giving recipients of in-home and community-based services\n\nand their family members a choice in the selection of services\n\nneeded and providers to be utilized enhances a sense of dignity and\n\nautonomy for those individuals receiving care; and\n\n3. Providing consumers and their families with choice and\n\ncontrol over their lives is a goal that should be supported.\n\nD.
