Stat. tit. 56, § 56-198.11a","heading":"Oklahoma Consumer-Directed Personal Assistance and","body":"Support Services (Oklahoma CD-PASS) Act – Oklahoma Consumer-Directed\n\nPersonal Assistance and Support Services Demonstration Program –\n\nServices included – Duties of Aging Services Division.\n\nA. The Aging Services Division within the Department of Human\n\nServices, upon the approval of the Centers for Medicare and Medicaid\n\nServices, shall establish the Oklahoma Consumer-Directed Personal\n\nAssistance and Support Services (Oklahoma CD-PASS) Demonstration\n\nProgram. The purpose of the Oklahoma Consumer-Directed Personal\n\nAssistance and Support Services Demonstration Program shall be to\n\nenhance the range of choices and options for Medicaid-eligible\n\nconsumers, on a voluntary basis, who require long-term care support\n\nservices, and to assist families with a Medicaid-eligible member who\n\nrequires long-term care support services to arrange and purchase\n\ntheir own personal care and related services.\n\nB. The Oklahoma Consumer-Directed Personal Assistance and\n\nSupport Services Demonstration Program includes, but is not limited\n\nto, the following types of services:\n\n1. a. Basic services, such as getting a recipient in and out\n\nof a bed or in or out of a wheelchair or motorized\n\nchair, or both,\n\nb. Assisting with certain bodily functions, such as\n\nbathing and personal hygiene, dressing and grooming,\n\nand feeding including preparation and cleanup;\n\n2. Ancillary services such as shopping and cleaning;\n\n3. Companion-type services such as transportation, letter\n\nwriting and reading; and\n\n4. Any other service requested by the eligible recipient\n\nneeding care and services.\n\nC. 1. In developing the Oklahoma Consumer-Directed Personal\n\nAssistance and Support Services Demonstration Program, the Aging\n\nServices Division shall develop guidelines, eligibility criteria,\n\nprogram performance standards, and techniques to evaluate the\n\noutcomes of the Oklahoma Consumer-Directed Personal Assistance and\n\nSupport Services Demonstration Program.\n\n2. The Demonstration Program, at a minimum, shall have the\n\nfollowing requirements:\n\na. the cost in the aggregate of the services offered\n\nthrough the CD-PASS Program care plan shall be equal\n\nto or less than the average cost of the Advantage\n\nWaiver Program service or personal care plan as\n\napplicable,\n\nb. the baseline level of consumer satisfaction shall be\n\nmeasured by an independent third party prior to\n\ninitiation of the Demonstration Program,\n\nc. the scope of services offered within the CD-PASS\n\nProgram shall comply with current state statutes and\n\nrules, and federal regulations, and\n\nd. program evaluation which shall include an indication\n\nof whether:\n\n(1) consumer satisfaction for CD-PASS Program\n\nparticipants is higher than or equal to consumer\n\nsatisfaction for Advantage Waiver Program\n\nclients, as measured by an independent third\n\nparty, and\npe of services offered within the CD-PASS\n\nProgram shall comply with current state statutes and\n\nrules, and federal regulations, and\n\nd. program evaluation which shall include an indication\n\nof whether:\n\n(1) consumer satisfaction for CD-PASS Program\n\nparticipants is higher than or equal to consumer\n\nsatisfaction for Advantage Waiver Program\n\nclients, as measured by an independent third\n\nparty, and\n\n(2) the percentage of delivered hours of the CD-PASS\n\nProgram client care plan are greater than or\n\nequal to the percentage of delivered hours of the\n\nAdvantage Waiver Program service or personal care\n\nplan.\n\nD. The Aging Services Division may:\n\n1. Consult with various federal, state and local entities in\n\norder to fulfill the purposes of the Oklahoma Consumer-Directed\n\nPersonal Assistance and Support Services Demonstration Program;\n\n2. Contract with entities in fulfilling the purposes of the\n\nOklahoma Consumer-Directed Personal Assistance and Support Services\n\nDemonstration Program; and\n\n3. Upon the approval of the Centers for Medicare and Medicaid\n\nServices and the availability of funds, expand the Oklahoma\n\nConsumer-Directed Personal Assistance and Support Services\n\nDemonstration Program statewide if the evaluation provided for in\n\nsubsection C of this section demonstrates consumer satisfaction with\n\nand cost effectiveness in the delivery of the Program.\n\nE.
