Stat. tit. 56, § 56-198.11b","heading":"Public policy - Strategic Planning Committee on the","body":"Olmstead Decision.\n\nA. It is the public policy of the State of Oklahoma to:\n\n1. Recognize and support individuals with disabilities by\n\ntreating them with dignity and respect as productive members of our\n\nsociety in Oklahoma;\n\n2. Acknowledge their contributions as productive and\n\nindependent citizens in the state and the useful work they perform\n\nin their local communities;\n\n3. Support a service delivery system for individuals with\n\ndisabilities ensuring that the individuals, their families, or\n\nguardians are well informed as to the types of services and\n\nresources available to such individuals in order to encourage their\n\nindependence, self-esteem, and self-worth, regardless of the\n\nseverity of the disability; and\n\n4. Recognize that self-choice on the part of individuals with\n\ndisabilities is critical and that the most appropriate setting for\n\nmeeting their needs should be a paramount consideration when\n\ndetermining appropriate placement of such individuals in community-\n\nbased programs, residential care facilities, or any other placement\n\nor service that benefits the needs and well-being of individuals\n\nwith disabilities.\n\nB. There is hereby created the Strategic Planning Committee on\n\nthe Olmstead Decision to continue until July 1, 2010. The purpose\n\nof the Committee is to monitor the implementation of the\n\ncomprehensive, strategic plan for the State of Oklahoma regarding\n\nthe Olmstead Decision.\n\nC. The Strategic Planning Committee on the Olmstead Decision\n\nshall be composed of fifteen (15) appointed members, eighteen (18)\n\nex officio members, and representatives from disability-related\n\norganizations, all of whom shall be voting members, as follows:\n\n1. a. The Governor shall appoint:\n\n(1) one person who is a community placement service\n\nprovider for persons with disabilities,\n\n(2) one person who is an advocate for persons with\n\ndisabilities,\n\n(3) one parent or personal representative of a person\n\nwith disabilities,\n\n(4) one member from an organization that provides\n\ndirect care services within the Advantage Waiver\n\nProgram, and\n\n(5) one member who is a consumer of disability\n\nservices.\n\nb. The President Pro Tempore of the Senate shall appoint:\n\n(1) two members of the State Senate,\n\n(2) two members who are consumers of disability\n\nservices, and\n\n(3) one member with a disability who has moved from\n\nan institutional setting into the community.\n\nc. The Speaker of the House of Representatives shall\n\nappoint:\n\n(1) two members of the House of Representatives,\n\n(2) one parent or personal representative of a person\n\nwith disabilities,\n\n(3) one member who is a consumer of disability\n\nservices, and\n\n(4) one member with a disability who has moved from\n\nan institutional setting into the community;\n\n2. The ex officio voting members shall be:\n\na. the Attorney General, or designee,\n\nb. the Director of the Department of Human Services, or\n\ndesignee,\n\nc. the Division Director of the Developmental\n\nDisabilities Division of the Department of Human\n\nServices, if not the designee of the Director of Human\n\nServices,\n\nd. the State Commissioner of Health, or designee,\n\ne. the Commissioner of the Department of Mental Health\n\nand Substance Abuse Services, or designee,\n\nf. the Administrator of the Oklahoma Health Care\n\nAuthority, or designee,\n\ng. the Director of the Office of Management and\n\nEnterprise Services, or designee,\n\nh. the Director of the State Department of Rehabilitation\n\nServices, or designee,\n\ni. the Director of the Office of Disability Concerns, or\n\ndesignee,\n\nj. the Director of the Oklahoma Employment Security\n\nCommission, or designee,\n\nk. the state coordinator for the federal Ticket To Work\n\nand Work Incentive Act, if not the designee of the\n\nOklahoma Employment Security Director,\n\nl. the Executive Director of a local housing authority,\n\nor designee,\n\nm. the Executive Director of the Oklahoma Housing Finance\n\nAgency, or designee,\ncerns, or\n\ndesignee,\n\nj. the Director of the Oklahoma Employment Security\n\nCommission, or designee,\n\nk. the state coordinator for the federal Ticket To Work\n\nand Work Incentive Act, if not the designee of the\n\nOklahoma Employment Security Director,\n\nl. the Executive Director of a local housing authority,\n\nor designee,\n\nm. the Executive Director of the Oklahoma Housing Finance\n\nAgency, or designee,\n\nn. the State Superintendent of Public Instruction, or\n\ndesignee,\n\no. the Director of the Department of Transportation, or\n\ndesignee,\n\np. the Commissioner of Labor, or designee,\n\nq. a representative from a local transit authority, or\n\nfrom a Community Action Agency, that provides\n\ntransportation services to individuals with\n\ndisabilities, and\n\nr. the Director of the Oklahoma Commission on Children\n\nand Youth, or designee; and\n\n3. The membership shall also include as voting members:\n\na. one representative from the Developmental Disabilities\n\nCouncil,\n\nb. one representative from the Statewide Independent\n\nLiving Council,\n\nc. two representatives from the Centers for Independent\n\nLiving,\n\nd. one representative from the Center for Learning and\n\nLeadership,\n\ne. one representative from the Oklahoma Disability Law\n\nCenter,\n\nf. one representative from ABLE-Tech,\n\ng. one representative from the Oklahoma Mental Health\n\nConsumer Council, and\n\nh. a representative of a nonprofit agency, in a county of\n\nfive hundred thousand (500,000) or more population,\n\nthat collaborates on programs and services for persons\n\nwith disabilities.\n\nD. 1. Members shall serve at the pleasure of their appointing\n\nauthorities. A vacancy on the Committee shall be filled by the\n\noriginal appointing authority.\n\n2. A majority of the members of the Committee shall constitute\n\na quorum. A majority of the members present at a meeting may act\n\nfor the Committee.\n\n3. The President Pro Tempore and the Speaker shall each\n\ndesignate a cochair from among the members of the Committee.\n\n4. The cochairs of the Committee shall annually establish a\n\nschedule of each year's meetings. The Committee shall meet at least\n\nfour times annually.\n\n5. Proceedings of all meetings of the Committee shall comply\n\nwith the provisions of the Oklahoma Open Meeting Act.\n\n6. The Committee may divide into subcommittees in furtherance\n\nof its purpose.\n\nE. 1. The Department of Human Services and the Office of the\n\nAttorney General shall serve as lead agencies and as such shall\n\nprovide primary staffing for the Committee. Appropriate personnel\n\nfrom the Oklahoma Health Care Authority and the Department of Mental\n\nHealth and Substance Abuse Services shall also assist with the work\n\nof the Committee.\n\n2. The Committee may use the expertise and services of the\n\nstaffs of the State Senate and the House of Representatives and may,\n\nas necessary, employ and contract for the advice and services of\n\nexperts in the field as well as other necessary professional and\n\nclerical staff.\n\nF. All departments, officers, agencies, and employees of this\n\nstate shall cooperate with the Committee in fulfilling its duties\n\nand responsibilities including, but not limited to, providing any\n\ninformation, records, or reports requested by the Committee.\n\nG. Members of the Committee shall receive no compensation for\n\ntheir service, but shall receive travel reimbursement as follows:\n\n1. Legislative members of the Committee shall be reimbursed for\n\nnecessary travel expenses incurred in the performance of their\n\nduties in accordance with the provisions of Section 456 of Title 74\n\nof the Oklahoma Statutes; and\n\n2. Nonlegislative members of the Committee shall be reimbursed\n\nby their appointing authorities or respective agencies for necessary\n\ntravel expenses incurred in the performance of their duties in\n\naccordance with the State Travel Reimbursement Act.\n\nH. The duties and responsibilities of the Strategic Planning\nccordance with the provisions of Section 456 of Title 74\n\nof the Oklahoma Statutes; and\n\n2. Nonlegislative members of the Committee shall be reimbursed\n\nby their appointing authorities or respective agencies for necessary\n\ntravel expenses incurred in the performance of their duties in\n\naccordance with the State Travel Reimbursement Act.\n\nH. The duties and responsibilities of the Strategic Planning\n\nCommittee on the Olmstead Decision shall include, but need not be\n\nlimited to:\n\na. monitoring the implementation of the comprehensive,\n\nstrategic plan for Oklahomans with disabilities,\n\npursuant to the Olmstead Decision,\n\nb. reviewing the service delivery system within the state\n\nand the way in which persons with disabilities\n\ncurrently access the services,\n\nc. reviewing existing statutes, policies, programs,\n\nservices and funding sources that affect Oklahomans\n\nwith disabilities, including, but not limited to,\n\nidentifying unique approaches and strategies to\n\nfunding,\n\nd. identifying and reviewing funding and resource\n\ninformation available to persons with disabilities and\n\ntheir families in this state,\n\ne. identifying gaps and barriers in programs and services\n\nto individuals with disabilities and making any\n\nrecommendations to enhance programs and the delivery\n\nsystem for persons with disabilities in Oklahoma,\n\nf. examining the feasibility of expanding the eligibility\n\ncriteria for people served by the Developmental\n\nDisabilities Services Division of the Department of\n\nHuman Services to include people with disabilities who\n\nare not eligible for the Advantage Waiver program\n\nthrough the Aging Services Division and those with\n\nother diagnoses who are at risk of out-of-home\n\nplacement,\n\ng. studying the feasibility and impact of requiring that\n\nassistive technology suppliers in this state meet\n\nnational certification requirements, and\n\nh. taking all other actions necessary to monitor and\n\nassist with the implementation of the comprehensive\n\nstrategic plan.\n\nI.
