Stat. tit. 56, § 56-198.14","heading":"Definitions","body":"As used in the Oklahoma Self-Directed Care Act:\n\n1. “Ancillary services” means services in addition to basic\n\nservices provided to a consumer and includes the following:\n\na. housekeeping chores which are incidental to the basic\n\nservices furnished, or which are essential to the\n\nhealth and welfare of the consumer, and\n\nb. transportation services to enable the consumer to gain\n\naccess to waiver services and other community\n\nservices, activities and resources;\n\n2. “Basic services” shall include, but not be limited to:\n\na. getting in and out of bed, wheelchair or motor\n\nvehicle,\n\nb. assistance with routine bodily functions including\n\nbathing and personal hygiene, dressing and grooming,\n\nand eating,\n\nc. assistance in acquiring, retaining and improving self-\n\nhelp, socialization and adaptive skills necessary to\n\nreside successfully in a home- and community-based\n\nsetting,\n\nd. respite services for non-paid caregivers, which may\n\ninclude services consisting of general household\n\nactivities such as meal preparation and routine\n\nhousehold care, and\n\ne. health maintenance activities including, but not\n\nlimited to, administration of medications by oral,\n\nrectal, vaginal, otic, ophthalmic, nasal, skin,\n\ntopical, transdermal and gastrostomy tube routes,\n\nfeedings through a tube, surface care of stoma sites,\n\nirrigation of catheter, and wound care if such\n\nactivities in the opinion of the attending physician\n\nor licensed registered nurse may be performed safely\n\nin the home or community by a consumer-employed\n\ncaregiver who has successfully completed competency-\n\nbased training approved by the Department of Human\n\nServices;\n\n3. “Budget allowance” means the amount of money made available\n\neach month to a consumer to purchase needed home- and community-\n\nbased care services, based on the results of a functional needs\n\nassessment to be developed pursuant to the provisions of this act;\n\n4. “Consumer” means a person who has chosen to participate in\n\nthe program, has met the enrollment requirements, and has received\n\nan approved budget allowance;\n\n5. “Fiscal intermediary” means an entity approved by the\n\nOklahoma Health Care Authority that helps a consumer manage the\n\nbudget allowance of the consumer, retains the funds, and processes\n\nemployment information, processes tax information, processes\n\nworkers’ compensation insurance premiums, reviews records to ensure\n\ncorrectness, writes paychecks to providers, and delivers paychecks\n\nto the consumer for distribution to providers and caregivers;\n\n6. “Legal representative” means a person who is a legal\n\nguardian or conservator or who holds a durable power of attorney\n\nauthorizing the making of health and medical care decisions as\n\nrequired by this section for a consumer;\n\n7. “Personal care services” means those basic and ancillary\n\nservices which enable the consumer in need of in-home care to live\n\nin the home and community of the consumer rather than in an\n\ninstitution and to carry out functions of daily living, self-care\n\nand mobility;\n\n8. “Program” means the Self-Directed Care Pilot Program;\n\n9. “Provider” means:\n\na. a person licensed to render services that are eligible\n\nfor reimbursement under this program, for whom the\n\nconsumer is not the employer of record, or\n\nb. a consumer-employed caregiver for whom the consumer is\n\nthe employer of record; and\n\n10. “Representative” means an uncompensated individual\n\ndesignated by the consumer to assist in managing the budget\n\nallowance and needed services of the consumer.","path":["OK Code","Title 56"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os56.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2a1f6f8049d4545de87ac88a03c26816e411980b1f228fe80a7c7c8e6c2f8231","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-56-56-198.13","next":"us-ok/okla.-stat.-tit.-56-56-198.15"},"notice":"GroundRules: Original legal text.
