Stat. tit. 56, § 56-200d","heading":"State Medicaid Plan provider contracts - Terms and","body":"conditions - Termination - Annual inspection of facilities.\n\nA. Every contract pursuant to the State Medicaid Plan entered\n\ninto between the Department of Human Services and facilities that\n\nprovide inpatient or residential mental health services to persons\n\neighteen (18) years of age or younger who are or may be eligible for\n\nassistance through Title XIX of the federal Social Security Act\n\nshall incorporate terms and conditions for the care, treatment and\n\nservices to be provided.\n\nB. Said terms and conditions shall be substantially the same as\n\nthose included in placement agreements for acute or freestanding, as\n\nappropriate for the facility, psychiatric care for children and\n\nyouth who are in the legal custody of the Department of Human\n\nServices and shall include, but not be limited to:\n\n1. Primary care, treatment and counseling services;\n\n2. Educational services;\n\n3. Face-to-face visitation by the attending physician,\n\ntreatment plans, discharge planning, reports on the progress of the\n\nchild and other reports as necessary and appropriate;\n\n4. Use of medications;\n\n5. Communicable diseases;\n\n6. Visitation and correspondence;\n\n7. Use of restraints, seclusion, physical force and\n\ndisciplinary measures; and\n\n8. Inspections and reviews of the care, treatment and services\n\nprovided.\n\nC. The Department shall immediately initiate procedures for the\n\ntermination of said contract when:\n\n1. A contracting facility continually violates the terms and\n\nconditions required by this section; or\n\n2. The conditions within the facility pose serious harm or a\n\nthreat of serious harm to patients or residents who are eighteen\n\n(18) years of age or under and have been admitted for the purpose of\n\nmental health or chemical dependency treatment.\n\nD.
