Stat. tit. 56, § 56-230.62","heading":"Contracts for literacy remediation, work activities,","body":"training and other services.\n\nA. The Department of Human Services shall, as appropriate,\n\nprovide literacy remediation, English as a second language, work\n\nactivities, training, and other services to recipients pursuant to\n\nthe Temporary Assistance for Needy Families (TANF) program through\n\ncontracts. In contracting for English as a second language, work\n\nactivities, training, or other services, the following terms and\n\nconditions shall apply:\n\n1. A contract shall be performance based. Whenever possible,\n\npayment shall be based on performance outcomes that include, but are\n\nnot limited to, such factors as job entry, job entry at a target\n\nwage, and job retention. Payment shall not be based on completion\n\nof training, education, or any other phase of the program\n\nparticipation process;\n\n2. A contract may include performance-based incentive payments\n\nthat may vary according to the extent to which a recipient is more\n\ndifficult to place. Contract payments may be weighted\n\nproportionally to reflect the extent to which a recipient has\n\nlimitations associated with the long-term receipt of welfare and\n\ndifficulty in maintaining employment. The factors may include the\n\nextent of a recipient's prior receipt of welfare, lack of employment\n\nexperience, poor literacy skills, lack of education, lack of job\n\nskills, and any other factors determined appropriate by the\n\nDepartment; and\n\n3. The Department is hereby authorized to contract with\n\ncommercial, charitable, religious or faith-based organizations to\n\nprovide the necessary services pursuant to the TANF program as\n\nprovided in this section.\n\nB. Subject to the availability of funds, the Department shall\n\nexplore and recommend technological enhancements and funding\n\nnecessary to support the work activities, training and other\n\nservices provided to recipients as described in subsection A of this\n\nsection.
