A hearing shall be held at the time and place given on the\n\nnotice of support debt served upon the obligor or the attorney for\n\nthe obligor, with a duly qualified administrative law judge\n\nappointed for that purpose by the Department. The hearing shall be\n\nheld in the county of residence of the custodial parent or guardian\n\nof the child or if the custodian resides out of state, the hearing\n\nshall be held in the county of residence of the obligor. The\n\nhearing shall be conducted according to rules promulgated by the\n\nDepartment. The rules shall provide to both parties the right to\n\nconfront and cross-examine witnesses, to present witnesses, and to\n\nbe represented by an attorney or other person. After the evidence\n\nhas been presented at a hearing, the administrative law judge shall\n\nenter an order which shall be in writing and contain findings of\n\nfact and conclusions of law as to each contested issue. Each order\n\nshall include provisions requiring the obligor to inform the\n\nDivision of the obligor's current address, the name and address of\n\nthe obligor's current employer, and the obligor's access to health\n\ninsurance and other insurance policy information. The order shall\n\nbe submitted to the district office and to the obligor or the\n\nattorney for the obligor by hand delivery by the administrative law\n\njudge or by certificate of mailing, within twenty (20) days after\n\nthe conclusion of the hearing.\n\nB. If, during the hearing, the administrative law judge finds\n\nthat the issues presented will require further consideration or\n\nevidence either administratively or through the district court\n\nbefore adjudication, the administrative law judge may enter a\n\ntemporary order for child support, pending resolution of those\n\nissues during a subsequent administrative or court hearing. The\n\ntemporary order shall be enforced until superseded by a final\n\nadministrative order or district court order and may be filed in the\n\noffice of the court clerk.\n\nC. If an appeal is not perfected by the obligor or district\n\noffice, the order of the administrative law judge shall be final,\n\nsubject to collection action, and shall be filed in the office of\n\nthe court clerk in the county of residence of the custodian of the\n\nchild or, if the custodian resides out of state, in the county of\n\nresidence of the obligor, or elsewhere as provided in this act. The\n\nadministrative order shall be enforced by the district court in the\n\nsame manner as an order of the district court.\n\nD. If the obligor fails to appear for the hearing after proper\n\nservice, an administrative order will be entered. The order shall\n\ninclude findings of facts and conclusions of law and shall be\n\nsubject to collection action, and shall be filed in the office of\n\nthe court clerk in the county of residence of the custodian of the\n\nchild or, if the custodian resides out of state, in the county of\n\nthe residence of the obligor, or elsewhere as provided in this act.\n\nThe administrative order shall be enforced by the district court in\n\nthe same manner as an order of the district court.\n\nE. Any order for periodic support payments made pursuant to the\n\nprovisions of this title shall be payable to the Division for as\n\nlong as the Division is providing support enforcement.
