Final orders of the Office of Administrative Hearings:\n\nChild Support (OAH) may be appealed to the district court pursuant\n\nto this section by any party directly affected and showing\n\naggrievement by the order, or by the Oklahoma Department of Human\n\nServices.\n\n2. An appeal shall be commenced by filing a petition in error\n\nwith the clerk of the district court in the county of the underlying\n\ndistrict court order, if any, or if there is no underlying district\n\ncourt order filed in this state, the petition in error shall be\n\nfiled in the county of residence of the custodian of the child, or\n\nif the custodian resides out-of-state, in the county of residence of\n\nthe obligor within thirty (30) days from the date the order is\n\neither provided in person or mailed by OAH to all parties. The time\n\nlimit prescribed in this paragraph for filing the petition in error\n\nshall not be extended. The petition in error shall be served by\n\ncertified mail on the district child support office. Further, a\n\ncopy of the petition in error shall be mailed by regular mail to the\n\nOffice of Administrative Hearings: Child Support.\n\n3. A designation of record shall be filed prior to or\n\nconcurrently with the filing of the petition in error. The manner\n\nof perfection of the record of the proceedings to be reviewed and\n\nthe time for its completion shall be in accordance with rules and\n\nforms prescribed by the Oklahoma Supreme Court.\n\n4. The appeal shall not stay the execution of any order of the\n\nOAH unless the district court, for cause shown, shall order the\n\nadministrative order be stayed pending such appeal.\n\n5. The district court may affirm the decision or remand the\n\ncase for further proceedings. Additionally, the district court may\n\nset aside, reverse or modify the decision if substantial rights of\n\nthe appellant have been prejudiced because the findings, inferences,\n\nconclusions or decisions are:\n\na. in violation of constitutional provisions,\n\nb. in excess of the statutory authority or jurisdiction\n\nof OAH,\n\nc. made upon unlawful procedure,\n\nd. affected by other error of law,\n\ne. clearly erroneous as not supported by substantial\n\nevidence in the record,\n\nf. arbitrary or capricious, or\n\ng. made without findings of fact upon issues essential to\n\nthe decision, although such findings of fact were\n\nrequested.\n\nB. The certified transcript, exhibits, pleadings, recordings of\n\nthe hearing and any written orders that pertain to the appealable\n\norder under review may constitute the record on appeal to the\n\ndistrict court in compliance with rules prescribed by the Oklahoma\n\nSupreme Court. OAH shall prepare or direct the preparation of the\n\nofficial transcript by a licensed court reporter, if a transcript is\n\nrequested. The party seeking a copy of the transcript of the\n\nhearing shall prepay all costs of transcription and pay a reasonable\n\ndeposit or provide adequate indemnity prior to preparation of the\n\ntranscript. If a party is financially unable to pay the\n\ntranscription costs, the party shall provide OAH and the district\n\noffice with an in forma pauperis affidavit which verifies the\n\ninability to pay. If OAH determines the party is financially unable\n\nto pay transcription costs, a transcript will be provided by OAH.\n\nThe transcript shall not be provided prior to full payment, payment\n\nof a deposit, provision of adequate indemnity for all transcription\n\ncosts, or an order finding OAH will bear the costs of transcription.","path":["OK Code","Title 56"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os56.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"075235dc8a00df282ea7e646d3515e418fd92e10f6f5ada26a80fa477f0ab5a9","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-56-56-240.24","next":"us-ok/okla.-stat.-tit.-56-56-240.4"},"notice":"GroundRules: Original legal text.
