Stat. tit. 56, § 56-240.7","heading":"Release of child support arrearage information to","body":"consumer reporting agencies.\n\nA. Unless otherwise prohibited or restricted by federal law or\n\nregulation, the Commission for Human Services, by rule, shall adopt\n\na reasonable fee that shall be paid by consumer reporting agencies\n\nfor requests pursuant to this section. The fee shall not exceed the\n\nestimated average actual cost experienced by the Department in\n\nperforming the duties imposed upon it by this section.\n\nB. The Department of Human Services shall establish procedures\n\nfor the periodic release to consumer reporting agencies of the names\n\nand amounts of child support arrearages of obligors who owe past-due\n\nsupport. This information shall be released if the person obligated\n\nto pay child support pursuant to a support order is in arrears for\n\nchild support.\n\nC. For purposes of this section, the term \"consumer reporting\n\nagency\" means any person who, for a fee, dues, or on a cooperative\n\nnonprofit basis, regularly engages in the practice of assembling or\n\nevaluating consumer credit information or other information on\n\nconsumers for the purpose of furnishing consumer reports to third\n\nparties, and who uses any means or facility of interstate commerce\n\nfor the purpose of preparing or furnishing consumer reports.\n\nD. Information shall not be made available to:\n\n1. Any consumer reporting agency which the Department or other\n\nappropriate agency determines does not have sufficient capability to\n\nsystematically and timely make accurate use of the information; or\n\n2. Any entity which has not provided satisfactory proof to the\n\nDepartment that the entity is a consumer reporting agency.\n\nE.
