The State Treasurer shall facilitate access to a qualified\n\nABLE program through the selection of one or more of the following\n\noptions:\n\n1. Establishing an Achieving a Better Life Experience program\n\nas provided under the Tax Increase Prevention Act of 2014, Pub. L.\n\nNo. 113-295;\n\n2. Contracting with a state with a qualified ABLE program;\n\n3. Joining a consortium of states in administering a qualified\n\nABLE program; or\n\n4. Operating a website to assist eligible individuals with the\n\nselection of a qualified program.\n\nB. In the event the State Treasurer elects to establish an ABLE\n\nprogram pursuant to paragraph 1 of subsection A of this section, he\n\nor she shall:\n\n1. Develop and implement the program in a manner consistent\n\nwith this act through the adoption of guidelines and procedures;\n\n2. Retain professional services, if necessary, including\n\naccountants, auditors, consultants and other experts;\n\n3. Seek rulings and other guidance, if necessary, from the\n\nUnited States Department of the Treasury, the Internal Revenue\n\nService and the Oklahoma Attorney General relating to the program;\n\n4. Make changes to the program required for the participants in\n\nthe program to obtain the federal income tax benefits or treatment\n\nprovided by Section 529A of the Internal Revenue Code;\n\n5. Interpret, in policies, guidelines and procedures, the\n\nprovisions of the ABLE program broadly in light of its purpose and\n\nobjectives;\n\n6. Develop a schedule of application fees and other necessary\n\nfees and charges in connection with any agreement, contract or\n\ntransaction relating to the program that are sufficient to offset\n\nthe administrative and staffing costs associated with the\n\nimplementation and administration of this program;\n\n7. Select the financial institution or institutions to act as\n\nthe depositories and managers of the program accounts in accordance\n\nwith this act. For purposes of selecting such institutions and\n\nmanagers, the Office of the State Treasurer shall be exempt from The\n\nOklahoma Central Purchasing Act. The Treasurer shall develop a\n\ncompetitive process by which the institutions and managers will be\n\nselected; and\n\n8. Be exempt from the rulemaking provisions of the\n\nAdministrative Procedures Act when adopting guidelines for the ABLE\n\nprogram; provided, any such guidelines affecting existing or\n\npotential participants in the ABLE program may only be implemented\n\nafter reasonable notice to the public and a public hearing in a\n\nmanner similar to the requirements of the Administrative Procedures\n\nAct.\n\nC. In the event the State Treasurer elects to contract with\n\nanother state or join a consortium pursuant to the provisions of\n\nsubsection A of this section, he or she shall:\n\n1. Select the state or consortium which the Treasurer has\n\ndetermined will provide the greatest benefit to eligible\n\nindividuals. For purposes of selecting such state or consortium,\n\nthe Office of the State Treasurer shall be exempt from The Oklahoma\n\nCentral Purchasing Act. The Treasurer shall develop a competitive\n\nprocess by which the state or consortium will be selected; and\n\n2.
