Every Medicaid member enrolled in a contracted entity shall\n\nhave the right to select his or her primary care provider and to\n\nchange his or her primary care provider at any time, as long as the\n\nselected primary care provider is a participating provider. Any\n\nparent or guardian of a Medicaid member who is a minor child\n\nenrolled in a contracted entity shall have the right to select the\n\nprimary care provider for the member's minor child and to change the\n\nprimary care provider at any time, as long as the selected primary\n\ncare provider is a participating provider.\n\nB. If a member, or parent or guardian of a member who is a\n\nminor child, does not select a primary care provider, the contracted\n\nentity shall notify the member, parent, or guardian that he or she\n\nneeds to select a primary care provider and shall send the member,\n\nparent, or guardian the name, contact information, employer, and any\n\nother applicable information as determined by the Oklahoma Health\n\nCare Authority of the three primary care providers nearest to the\n\nmember's home address that are contracted with the contracted\n\nentity.\n\nC. 1. If, after the contracted entity sends the information\n\ndescribed in subsection B of this section, the member, parent, or\n\nguardian does not select a primary care provider within a time\n\ndetermined by the Authority, the contracted entity shall assign the\n\nmember to a primary care provider in accordance with the process\n\ndescribed in paragraph 2 of this subsection.\n\n2. The Authority shall develop and implement a process for the\n\nassignment by contracted entities of Medicaid members who do not\n\nselect a primary care provider to a primary care provider.
