For Medicaid managed care plans, the Oklahoma Health Care\n\nAuthority shall ensure that the insurers, health plans, and managed\n\ncare plans comply with federal and state laws, rules, and\n\nregulations applicable to coverage for mental health or substance\n\nuse disorder services.\n\nB. Contracts with Medicaid managed care plans must require\n\nentities to conduct regular parity compliance analysis that contain\n\nthe information described in 42 U.S.C., Section 300gg–26(a)(8)(i-v)\n\nfor each nonquantitative treatment limitation imposed on mental\n\nhealth or substance use disorder benefits in any classification of\n\ncare.\n\nC. Contracts with Medicaid managed care plans must include\n\nlanguage requiring managed care plans and entities to conduct parity\n\nanalysis described in subsection B of this section for a\n\nnonquantitative treatment limitation whenever as-written or in-\n\noperation changes or amendments are made to that nonquantitative\n\ntreatment limitation, including prior authorization requirements.\n\nD. State Medicaid programs and Children's Health Insurance\n\nPrograms (CHIP) must review and compile the analysis from all\n\nmanaged care, CHIP, and alternative benefit plans to ensure\n\ncompliance and address any noncompliance through a standardized\n\nprocess to mitigate findings of noncompliance.\n\nE. The Oklahoma Health Care Authority shall develop a\n\nstandardized process for receiving, investigating, substantiating,\n\nand resolving parity complaints.\n\nF. The Oklahoma Health Care Authority shall make public the\n\nsurveys, financial analysis, managed care contract audits, de-\n\nidentified substantiated parity complaints, and parity reports\n\nprepared by the managed care entities and plans and the reports they\n\nsubmit to document parity compliance.\n\nG. The Oklahoma Health Care Authority shall also make public\n\nany parity analysis, summary, or report submitted to the Centers for\n\nMedicare and Medicaid Services regarding the Oklahoma Medicaid\n\nmanaged care program within thirty (30) days of the state's\n\nsubmission of these reports to the Centers for Medicare and Medicaid\n\nServices.","path":["OK Code","Title 56"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os56.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"6dddc3ee04deecb8fc957d43c333c409de71ce8c2acae8b24d27b596cda2096e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-56-56-4005","next":"us-ok/okla.-stat.-tit.-56-56-411"},"notice":"GroundRules: Original legal text.
