Stat. tit. 57, § 57-227","heading":"Application - Exemption from Workers' Compensation Act -","body":"Liability for injuries.\n\nA. All provisions of this section and Section 228 of this\n\ntitle, except as otherwise noted herein, shall apply to eligible\n\noffenders who are:\n\n1. Assigned to a work program for any government entity of this\n\nstate pursuant to a municipal court order;\n\n2. Assigned to a community service program pursuant to a\n\ndeferred prosecution agreement pursuant to the provisions of Section\n\n305.2 of Title 22 of the Oklahoma Statutes;\n\n3. Assigned to a public works project pursuant to the\n\nprovisions of Sections 58, 58.1 or 58.2 of this title;\n\n4. Assigned to community service pursuant to a sentence ordered\n\npursuant to the provisions of subparagraph c of paragraph 1 of\n\nsubsection A of Section 991a, Section 991c or Section 995.3 of Title\n\n22 of the Oklahoma Statutes;\n\n5. Assigned to a public works project pursuant to the\n\nprovisions of Section 215 et seq. of this title;\n\n6. Assigned to community service as a condition of parole\n\npursuant to the provisions of Section 10 of Article VI of the\n\nConstitution of the State of Oklahoma;\n\n7. Assigned to an eleemosynary institution pursuant to the\n\nprovisions of Section 212 et seq. of this title;\n\n8. Assigned to any work release or private prison industry\n\nprograms pursuant to the provisions of this title;\n\n9. Assigned to the Community Service Sentencing Program\n\npursuant to the provisions of Section 991a-4 of Title 22 of the\n\nOklahoma Statutes, or\n\n10. Assigned to a work program of a nonprofit organization with\n\nor without compensation.\n\nB. Any eligible offender described in subsection A of this\n\nsection shall be exempt from the provisions of the Workers'\n\nCompensation Act, Section 1 et seq. of Title 85 of the Oklahoma\n\nStatutes. Provided, such exemption shall not apply to employment of\n\nsuch person by a private for-profit employer. Provided further,\n\nsuch exemption shall not apply to those inmates employed in private\n\nprison industries involving a for-profit employer which deal in\n\ninterstate commerce or which sell products or services to the\n\nfederal government.\n\nC. All state and local government agencies, nonprofit\n\norganizations, community service agencies, educational programs and\n\nother treatment programs are hereby immune from liability for torts\n\ncommitted by or against any eligible offender described in\n\nsubsection A of this section; provided, those entities having court-\n\nmandated jurisdiction over the persons described in paragraphs 3, 5,\n\n7 and 8 of subsection A of this section shall provide basic or\n\nnecessary medical and dental care to said persons in such instances.","path":["OK Code","Title 57"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os57.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e5f69a4c5f80c63e3079317a5da21ba5349f7c530880f589cbd9b9835f38cb54","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-57-57-226","next":"us-ok/okla.-stat.-tit.-57-57-228"},"notice":"GroundRules: Original legal text.
