Stat. tit. 57, § 57-353.1","heading":"Minimum and maximum terms of confinement – Assessment of","body":"terms by jury.\n\nIn all cases where a sentence of imprisonment in the State\n\nPenitentiary is imposed, the court, in assessing the term of the\n\nconfinement, may fix a minimum and a maximum term, both of which\n\nshall be within the limits now or hereafter provided by law as the\n\npenalty for conviction of the offense. The minimum term may be less\n\nthan, but shall not be more than, one-third (1/3) of the maximum\n\nsentence imposed by the court.
